WHEREAS, the City of Newark Department of Engineering, advertised for receipt of bids on March 23, 2017, for Contract No. 2017_02 Dr. Martin Luther King Jr. Memorial Park Improvements; and
WHEREAS, on April 21, 2017, the Department received three (3) bids for Contract No. 2017_02, Dr. Martin Luther King, Jr. Memorial Park Improvements, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, after reviewing the bids received, the Director of the Department of Engineering desires to award Contract No. 2017_02 Dr. Martin Luther King, Jr. Memorial Park Improvements, to the lowest responsible bidder, Shauger Property Services, Inc., 429 Dodd Street, East Orange, New Jersey 07017, in the amount not to exceed $346,497.90.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, Shauger Property Services, Inc., 429 Dodd Street, East Orange, New Jersey 07017, and execute Contract No. 2017_02, Dr. Martin Luther King, Jr. Memorial Park Improvements, in the total bid amount of $346,497.90.
2. Attached hereto is a Certification of Funds issued by the Director of Finance which states that there are available sufficient legally appropriated funds in the amount of $346,497.90, for the purpose set forth hereinabove.
3. The Director of the Department of Engineering shall file a fully executed copy of this Contract No. 2017_02 in the Office of the City Clerk.
4. No amendments or modifications to this contract are allowed without prior Municipal Council approval.
5. This contract is to be completed within a period of 180 calendar days from the date of a “Notice to Proceed” issued by the Director of the Department of Engineering.
6. The public bidding process under New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
7. Funds for this contract in the amount of $346,497.90 are provided from:

STATEMENT
