WHEREAS, pursuant to N.J.S.A. 40A:9-120, et seq., Jose Ruiz, of Newark, New Jersey 07104, was appointed as a Constable pursuant to Resolution 7R8-a, adopted at the July 8, 2021, Regular Municipal Council Meeting; and
WHEREAS, the Municipal Council wishes to amend Resolution 7R8-a adopted on July 8, 2021 to correct the Constable amount from $1,000.00 to $5,000.00 and to change the appointment date to the date of adoption of this amending Resolution;; and
WHEREAS, pursuant to N.J.S.A. 40A:9-125, Jose Ruiz, of Newark, New Jersey 07104, must give a bond, in such form and amount as prescribed by the Governing Body and approved as to form and sufficiency by the Corporation Counsel; and
WHEREAS, pursuant to N.J.S.A. 40A:9-121, a Constable must qualify within thirty (30) days of the initial adoption of the resolution of appointment, and shall hold office for a term of three (3) years.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The term of the Constable appointment of Jose Ruiz, of Newark, New Jersey 07104, is for a term of three (3) years from the date of appointment or the expiration of the Constable Bond, whichever occurs first.
2. The Constable Bond, in the amount of $5,000.00, issued to Jose Ruiz, of Newark, New Jersey 07104, is approved as to form, amount, and sufficiency.
STATEMENT
This amended Resolution authorizes and approves the form, amount, and sufficiency of the Constable Bond posted for Jose Ruiz, of Newark, New Jersey 07104, who was appointed to serve as a Constable in the City of Newark, New Jersey, for a period of three (3) years from the date of appointment or the expiration of the Constable Bond, whichever occurs first.
