WHEREAS, the State of New Jersey, Office of Emergency Management ("NJOEM") has been designated as the Grantee to receive administer, and disburse Federal Emergency Management Agency ("FEMA") Building Resilient Infrastructure and Communities ("BRIC") 2021 Newark Ironbound Resiliency HUB - Phase I grant funding for municipalities which will involve the design, environmental historic preservation (EHP) review and initial permitting; and

WHEREAS, the City of Newark desires to further the public interest by obtaining funding from FEMA Agency for the BRIC 2021 Newark Ironbound Resiliency HUB - to remediate a large section of the City exposed to coastal flooding in which some areas of the Ironbound experience disruptive street flooding several times a year; and

WHEREAS, on December 15, 2021, on behalf of the City of Newark, the Director of the Department of Water and Sewer Utilities submitted an application, identified as BRIC 2021 Newark Ironbound Resiliency HUB, to FEMA requesting grant funding in the amount of Thirteen Million Three Hundred Twenty Four Thousand Six Hundred Fifty-Five Dollars and Seventy Seven Cents ($13,324,655.77) from FEMA BRIC 2021 Newark Ironbound Resiliency HUB Program for Phase I (site investigation, engineering design and construction permitting for the proposed improvements at Anne Street School (installation of porous pavement and a subsurface storage compartment under the school parking lot and shelter building improvements) and Phase II (construction of the project); and

WHEREAS, as a result of this application, the City of Newark has been awarded Phase I in the amount of One Million Sixty Four Thousand Three Hundred Twenty Nine Dollars and Sixty Cents ($1,064,329.60) Federal Share for site investigation, engineering design and construction permitting for the proposed improvements at Anne Street School (installation of porous pavement and a subsurface storage compartment under the school parking lot and shelter building improvements) for the period of performance September 1, 2022 through August 31, 2025, Phase II shall be reviewed for approval upon completion of Phase I; and

WHEREAS, the City must execute a grant agreement with State of New Jersey, Office of Emergency Management in order to obtain the grant award with Three Hundred Thirty-two Thousand Six Hundred Three Dollars and No Cents ($332,603.00) matching funds required to accept Phase I for this project.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are hereby authorized to submit a grant application, identified as BRIC 2021 Newark Ironbound Resiliency Hub Program and accept Phase I award, on behalf of the City of Newark, grant funding in the amount of One Million Sixty Four Thousand Three Hundred and Twenty Nine Dollars and Sixty Cents ($1,064,329.60) from the Federal Emergency Management Agency ("FEMA") Fund for the implementation of the BRIC 2021 Newark Ironbound Resiliency HUB - Phase I in the Ironbound City of Newark which $332,603.00 City funds are required in acceptance of Phase I for this project for total project cost not to exceed $1,396,932.60.

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

3. The grant award Phase I in the amount of $1,064,329.60, from FEMA, administered by New Jersey Office of Emergency Management (NJOEM) is accepted (a copy of the award letter is attached hereto and made a part hereof.)

4. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, are hereby authorized to enter into and execute grant documents with NJOEM to receive and expend the grant award in the amount of $1,396,932.60 ($1,064,329.60 Federal Share and $332,603.00 Local Share) for the implementation of the BRIC 2021 Newark Ironbound Resiliency HUB - Phase I in the Ironbound City of Newark for the period of performance from September 1, 2022, through August 31, 2025, (a copy of the agreement is attached hereto and made a part hereof.)

5. Matching funds in the amount of $332,603.00 shall be provided from the following line appropriation of the Department of Water and Sewer Utility, Sewer Capital Budget: Business Unit 038; Department 800; Division 8007; Account 71970, Budget 2024.

6. The Director of The Department of Water and Sewer Utilities shall file a fully executed copy of the BRIC 2021 Newark Ironbound Resiliency HUB - Phase I award letter, the BRIC 2021 Newark Ironbound Resiliency HUB - Phase I agreement and a copy of the Certification of Funds for any required matching funds in the Office of City Clerk.


STATEMENT


This resolution ratifies and authorizes the Mayor and/or his designee, the Director of The Department of Water and Sewer Utilities, to submit an application for site investigation, engineering design and construction permitting for proposed improvements at Anne Street School (installation of porous pavement and a subsurface storage compartment under the school parking lot and shelter building improvements) to remediate coastal flooding in that area accept, and enter in an agreement for BRIC 2021 Newark Ironbound Resiliency HUB - Phase I funding in the amount of $1,064,329.60 from Federal Emergency Management Agency ("FEMA") and New Jersey Office of Emergency. Matching funds in the amount of $332,603.00 shall be provided from the municipal budget.
