WHEREAS, on or about May 15, 2017, and pursuant to Newark, New Jersey Municipal Code Article 4, §2:5-13.2e.1, the City of Newark (hereinafter referred to as “City”) entered into Emergency Contract # E-2017-15 with University Radiology Group PC, University Radiology at Trinitas, LLC, 415 Morris Avenue, Elizabeth, New Jersey 07208 (hereinafter referred to as “Vendor”) in order for the City to provide X-ray services to patients receiving medical care from the City’s Federally Qualified Health Center Mary Eliza Mahoney Health Center, from the period of May 15, 2017 through August 14, 2017 (a copy of said Emergency Contract # E-2017-13 is attached hereto and made a part hereof); and
WHEREAS, the Division of Central Purchasing advertised for these X-ray services twice, on March 21, 2017, and then again on April 13, 2017, but received no responses; and
WHEREAS, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-5(3), the City is authorized to negotiate and award a contract for these services where no bids were received after two public advertisements; and therefore, the Department of Health and Community Wellness (hereinafter referred to as “DHCW”) is presently negotiating a contract with a vendor and will ultimately present this new contract to Municipal Council for approval; and
WHEREAS, the DHCW is in immediate and emergent need for Vendor to provide X-ray services for patients receiving medical care at Mary Eliza Mahoney Health Center, for the period of August 15, 2017 through May 14, 2018; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when an emergency affecting the public health, safety or welfare requires the immediate delivery of goods or the performance of services; and
WHEREAS, Newark, New Jersey Municipal Code Article 4, §2:5-13.2e.1(c) provides that no extension of an emergency contract shall be permitted without authorization by the Municipal Council by a resolution; and
WHEREAS, the DHCW desires to extend Emergency Contract # E-2017-13 in an amount not to exceed Ninety Thousand Dollars and Zero Cents ($90,000.00) for the period of August 15, 2017, through May 14, 2018, or until the City enters into a new contract for said services (the memo from the Director of the Department of Health and Community Wellness is attached hereto and made a part hereof).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to extend Emergency Contract #E2017-13 with University Radiology Group PC, University Radiology at Trinitas, LLC, 415 Morris Avenue, Elizabeth, New Jersey 07208, in an amount not to exceed Ninety Thousand Dollars and Zero Cents ($90,000.00) for the period of August 15, 2017 through May 14, 2018, or until a new contract is awarded, so that the City can provide X-ray services to patients receiving medical care services at the Mary Eliza Mahoney Health Centers.
2. The above-described extension of Emergency Contract # E2017-13 is hereby ratified from August 15, 2017, to the date of adoption of this authorizing resolution.
3. Attached hereto is a partial Certification of Funds in the amount of Forty-Five Thousand Dollars and Zero Cents ($45,000.00) from the Municipal Comptroller of the City of Newark and the line appropriation of the official budget which shall be charged is Business Unit NW051; Dept. ID G17; Division H27P0; Account # 72010, Budget Ref: B 2017 and NW011; Dept. ID 120; Division/Project 1202; Account# 72010; Budget B2017. The balance of funds will be certified from the 2018 budget.
4. Copies of this resolution and the above-described extended emergency contract shall be filed with the Office of the City Clerk, by the Director of the Department of Health and Community Wellness.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness, to extend Emergency Contract # E2017-13 with University Radiology Group PC, University Radiology at Trinitas, LLC, for the provision of medical X-ray services, for an amount not to exceed $90,000.00, for the period of August 15, 2017 through May 14, 2018, or until a new contract is authorized.
