                      WHEREAS, Port Newark Container Terminal, LLC (hereinafter “PNCT”) located at 241 Calcutta Street, Port Newark, New Jersey 07114, in collaboration with Invest Newark, 111 Mulberry Street, Newark, New Jersey 07102, wishes to provide a gift sponsorship to the City of Newark’s Department of Health and Community Wellness (“DCHW”), Office of Homelessness to defray costs; and

 

WHEREAS, on or about November 18, 2025 PNCT in collaboration with Invest Newark donated a used 2022 Ford Transit Connect Passenger Wagon Vehicle (“Vehicle”) with a value of Twenty-Six Thousand and Eight Hundred Forty Dollars and Zero Cents ($26,840.00) to support the City’s Office of Homeless Services’ Street Outreach Efforts at no cost to the City (a Gift Letter and Buyer’s Order are attached hereto); and

 

 

WHEREAS, pursuant to Local Public Contracts Law N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies, and gifts made to it and is empowered to utilize such bequests, legacies, and gifts in the manner set forth in the conditions of the bequest, legacy, and gift provided, however, that such bequest, legacy, or gift shall not be put to any use, which is inconsistent with the laws of the State of New Jersey and the United States of America; and

 

 

WHEREAS, PNCT and Invest Newark, fully understands and agrees it is not entitled to receive any direct benefit from the City in exchange for its gift; and

 

WHEREAS, pursuant to N.J.S.A. 40A: 5-29, the DCHW desires to accept the gift of the 2022 Ford Transit vehicle with a value of Twenty-Six Thousand Eight Hundred and Forty Dollars and Zero Cents ($26,840.00). 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council authorizes the Director of the Department of Health and Community Wellness, on behalf of the City of Newark, to accept the gift of a 2022 Ford Transit Connect Passenger Wagon Vehicle (“Vehicle”) with a value of Twenty-Six Thousand and Eight Hundred Forty ($26,840.00),   from Port Newark Container Terminal, LLC (“PNCT”), 241 Calcutta Street, Port Newark, NJ 07114 in collaboration with Invest Newark, 111 Mulberry Street, Newark, New Jersey 07102, to support the City’s Office of Homeless Services’ Street Outreach Efforts (a Gift Letter and Buyer’s Order are attached hereto).

 

2.                     No municipal funds shall be expended for the acceptance of this gift.

 

3.                     The Director of Health and Community Wellness shall file a copy of the gift letter in the Office of the City Clerk.

 

4.                     The acceptance of the gift is ratified from on or about December 10, 2025, to the date of adoption of this authorizing Resolution.

 

 

STATEMENT

                     This Resolution ratifies and authorizes the Director of the Department of Health and Community Wellness, on behalf of the City of Newark, to accept a gift of a 2022 Ford Transit Connect Passenger Wagon Vehicle with a value of Twenty-Six Thousand and Eight Hundred Forty ($26,840.00) to purchase  to support the City’s Office of Homeless Services’ Street Outreach Efforts.  This gift is at no cost to the City of Newark.
