WHEREAS, the New Jersey Recreation & Park Association (NJPRA), Aquatics Section, 1 Wheeler Way, Princeton NJ 08540-5915, would like to donate One Hundred (100) swimsuits and Forty-Eight (48) pairs of goggles to the City of Newark (City). NJRPA understands that some children would love to participate in aquatic programs often do not have the acceptable bathing attire to participate. The swimsuits and goggles have a value of approximately One Thousand Eight Hundred Dollars and Zero Cents ($1,800.00); and

 

WHEREAS, the Director of the Department of Recreation, Cultural Affairs & Senior Services  (“Department”) desires to accept the gift of the 100 swimsuits and 48 pairs of goggles and acknowledge the donation; and

 

WHEREAS, the City desires to expand and enrich the recreational opportunities to the residents of Newark and to partner with the NJPRA, Aquatics Section, by creating opportunities for all Newark residents, especially the City’s youth, and improve the activity in aquatic programs; and

 

WHEREAS, the NJPRA, fully understands and agrees that it is not entitled to receive any benefit from the City, Mayor Ras J. Baraka, or any other personnel affiliated with the City in exchange for the gift; and

 

 

WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of America.

 

 NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or the Director of the Department of Recreation, Cultural Affairs & Senior Services are authorized to accept the gift from New Jersey Recreation & Park Association, 1 Wheeler Way, Princeton NJ 08540-5915 of One Hundred (100) swimsuits and Forty-eight (48) pairs of goggles to make swimming accessible to Newark children who would love to participate in the aquatic programs who often do not have the acceptable bathing attire for participation.   

 

2.                     This gift of 100 swimsuits and 48 pairs of goggles to the City of Newark to make swimming more accessible to Newark children, is valued at approximately One Thousand Eight Hundred Dollars and Zero Cents ($1,800.00.)

 

3.                     The City acknowledges the generous donation of the swimsuits and goggles through this resolution. 

 

4.                     The acceptance of the gift is ratified from approximately August 17, 2023, to the date of adoption of this authorizing resolution.

 

5.                     No municipal funds will be expended for the acceptance of this gift.
