WHEREAS, President Biden signed the FY 2022 Consolidated Appropriations Act (P.L. 117-103) (“Act) into law on March 15, 2022, which included $841,405,095 in the State and Tribal Assistance Grants (STAG) account for 483 drinking water, wastewater, stormwater infrastructure, and water quality protection projects; and

 

WHEREAS, the U.S. Environmental Protection Agency (EPA) will award and administer water infrastructure projects identified as Congressionally Directed Spending (CDS) and Community Project Funding (CPF) items in Appropriations Acts. For Fiscal Year (FY) 2022, the Consolidated Appropriations Act (P.L. 117-103); and

 

WHEREAS, Congress directed EPA to fund specifically named community infrastructure projects pursuant to the Act upon successful review of recipient’s complete grant application package at which time a Grant Award will be made and Grant Agreement issued; and

 

WHEREAS, the City of Newark (“City”) Water Loss Monitoring Program was identified as a community infrastructure project, to receive Four Hundred Ninety Two Thousand Dollars and Zero Cents ($492,000.00) (“Grant Funds”) upon receipt and approval of the City’s complete application package, to purchase water loss monitoring equipment; and

 

WHEREAS, upon receipt of a Grant Award, the City desires to accept the Grant Funds.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark (Mayor) and/or his designee, the Business Administrator, are hereby authorized to submit an application to the United States Environmental Protection Agency (“EPA”) requesting grant funding in the amount of Four Hundred Ninety-Two Thousand Dollars and Zero Cents ($492,000.00) for the Water Monitoring Program (“Application”), pursuant to its identification as a community infrastructure project named as a recipient by Congress pursuant to the FY Consolidates Appropriations Act (P.L.117-103)(“Act”).

 

2.                     The Newark Municipal Council hereby ratifies its authorization of the Application to the EPA from the date of the submission to the date of adoption of this authorizing Resolution.

 

3.                     Upon notification of award, the Mayor of the City and or his designee, the Business Administrator, are authorized to accept the Grant Funds and enter into and execute the grant documents with the EPA to receive and expend the Grant Funds, for the period of September 1, 2025 through September 30, 2030.

 

4.        The Business Administrator shall file in the Office of the City Clerk a complete copy of the Application, Grant Agreement and any other documents relating to the grant.

 

 

STATEMENT

 

This Resolution authorizes the Mayor of the City of Newark, and/or his designee, the Business Administrator, to apply for and accept grant funding from the United States Environmental Protection Agency, in the amount of Four Hundred Ninety-Two Thousand Dollars and Zero Cents ($492,000.00) and to execute any agreement necessary to receive and expend the grant funds. The grant funds are for the Water Monitoring Program.
