WHEREAS, the City, through the Department of Recreation, Cultural Affairs and Senior Services is desirous of facilitating a one-day outdoor City event, “Newark Juneteenth Celebration”, open to all Newark residents, to provide families with theatrical performers, musical performers, spoken word artists, food, refreshments, kid’s zone with inflatable balloons, carnival rides and many other activities in a wholesome and nurturing environment (“Newark Juneteenth Celebration”) with the Mayor and the Newark Municipal Council; and
WHEREAS, the City, through the Department of Recreation, Cultural Affairs and Senior Services seeks to host this first ever City of Newark Juneteenth Celebration on Bergen Street between Lyons Avenue and Nye Avenue, Newark, New Jersey, on June 17, 2017 between 7:00am to 8:00pm; and
WHEREAS, June 19, 1865 is considered the date when the last slaves in America were freed. Juneteenth is the oldest known celebration commemorating the ending of slavery in the United States. It was on June 19, 1865 that the Union soldiers, led by Major General Gordon Granger, arrived at Galveston, Texas, with news that the Civil War had ended and that the enslaved were now free - but the Emancipation Proclamation which ended slavery, had taken effect two-and-a-half years before, and those states that had ignored the Proclmation still remained slave-holding states; and
WHEREAS, the Department of Recreation, Cultural Affairs and Senior Services desires to produce the first ever City-wide program observing Juneteenth in Newark -- “Newark Juneteenth Celebration”-- by obtaining professional services of, WEGOTUSKIDZ Non-Profit Corporation, for an amount not to exceed $11,950.00 and The Forces of Nature Dance Theatre, a Non-Profit Corporation, in an amount not to exceed $10,500.00; and
WHEREAS, the Department of Recreation, Cultural Affairs and Senior Services desires to obtain professional services, including but not limited to, theatrical performance, and artists in the fields of song, poetry, spoken word, dancers all of which are original and creative in character as an artistic endeavor as defined in N.J.S.A. 40A:11-2 and N.J.S.A. 40A:11-5(1)(a)(i) to be performed on Saturday, June 17, 2017, at the Newark Juneteenth Celebration, to be held on Bergen Street between Lyons Avenue and Nye Avenue, Newark, New Jersey, on June 17, 2017, between 7:00am to 8:00pm; and
WHEREAS, both vendors are Non-Profit organizations, therefore, State and Local Pay to Play laws do not apply; and
WHEREAS, this Contract is awarded without competitive bidding as an exception to public bidding, pursuant to N.J.S.A. 40A:11-5(1)(a)(i), professional services; and
WHEREAS, Local Public Contracts Law N.J.S.A. 40A:11-1, et seq. requires a Resolution of the Governing Body authorizing the award of contracts for professional services and further requires that the contract itself must be available for public inspection; and
WHEREAS, other goods and services for the Newark Juneteenth Celebration, such as inflatable balloons, carnival rides, refreshments and food will be procured through the Office of Central Purchasing through the statutory authority granted to the Purchasing Agent by N.J.S.A. 40A:11-3.
NOW, THEREFORE, BE RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, are hereby authorized to enter into and execute purchase orders and/or other appropriate documents, not to exceed a combined total of Twenty-two Thousand Four Hundred Fifty Dollars and Zero Cents ($22,450.00) with two (2) vendors: WEGOTUS KIDZ, 348 South 20th Street, Newark, New Jersey 07103 and The Forces of Nature Dance Theatre, 55 Edgecombe Avenue, New York, New York 10030, to provide professional services, including but not limited to theatrical performers, musical performers, poetry, song, spoken word artists for a one-day outdoor City celebration, open to all Newark residents at the Newark Juneteenth Celebration to be held at Bergen Street between Lyons Avenue and Nye Avenue, Newark, New Jersey, on June 17, 2017 between 7:00am to 8:00pm with the Mayor and the Newark Municipal Council.
2. Funds for the purchase of these professional services are encumbered on Department of Recreation, Cultural Affairs and Senior Services Fund NW011,1Dept. 601Div./Proj. 608 Account#71280 2017 Budget.
3. This contract is awarded without competitive bidding as an exception to public bidding pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(a)(i)), professional services, State Pay to Play and Ordinance on Pay-to-Play do not apply because the services are being provided by non-profit entities.
4. A copy of the executed purchase orders, or other required documentation shall be filed with the Office of the City Clerk by the Director of the Department of Recreation, Cultural Affairs and Senior Services.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, to execute purchase orders, or other required documentation in a total amount not to exceed Twenty-two Thousand Four Hundred Fifty Dollars and Zero Cents ($22,450.00) with two vendors to provide professional services which includes but is not limited to, theatrical performances, musical performers, poetry, song, spoken word artists at the first City of Newark Juneteenth Celebration to be held at Bergen Street between Lyons Avenue and Nye Avenue, Newark, New Jersey, on June 17, 2017 between 7:00am to 8:00pm.
