WHEREAS, the City of Newark’s (hereinafter, “City”) Department of Health and Community Wellness/Mary Eliza Mahoney Health Centers (hereinafter, “DHCW”/ “MEMHC) provides medical care services pursuant to and consistent with the Health Center Program laws and regulations (including Section 330 of Public Health Services Act, 42 U.S.C. Section 254b and 42 C.F.R. § 51c.301, et seq.); and
WHEREAS, The New Jersey Department of Health (the “NJDOH”) awarded an appropriation to Newark Beth Israel Medical Center (“NBIMC”) in accordance with the Fiscal Year 2025 Appropriations Act (P.L. 2024 c.22), as set forth in Grant & Award Number: MGMT24GIA039- 25GIA CNAH - City of Newark Access to Health Care Partnership (the “Appropriation”), and
WHEREAS, NBIMC agrees to provide DHCW/MEMHC a restricted grant not to exceed Four Hundred Twenty Four Thousand Two Hundred and Twenty-Six Dollars and Seventy Two Cents ($424,226.72) (“Grant Funds from the appropriation”), to be used solely for purchasing of equipment as depicted in the Memorandum of Understanding between the City of Newark and NBIMC, attached hereto and incorporated herein (“Equipment”); and
WHEREAS, the Director of the DHCW desires to accept said Grant Funds; and
WHEREAS, the City of Newark recognizes that NJDOH may extend the time of the Appropriation and/or provide additional funds when it becomes available; and
WHEREAS, the MOU may be amended the grant to reflect any time extension and/or increase or decrease of grant funds, as appropriate and which shall be subject to approval by the Municipal Council by resolution; and
WHEREAS, the Director of the Department of Health and Community Wellness desires to accept the Grant Funds from NBIMC pursuant to the Appropriation from NJDOH and execute the MOU governing said Grant Funds, with does not require City Funds.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept funds of the restricted grant not to exceed Four Hundred Twenty Four Thousand Two Hundred Twenty-Six Dollars and Seventy Two Cents ($424,226.72) (“Grant”) to be used solely for purchasing of equipment as set forth in Grant & Award Number: MGMT24GIA039- 25GIA CNAH - City of Newark Access to Health Care Partnership (the “Appropriation”) in accordance with the Fiscal Year 2025 Appropriations Act (P.L. 2024 c.22) received by both Newark Beth Israel Medical Center (“NBIMC”) 95 Old Short Hills Road, West Orange, New Jersey 07052 and the New Jersey Department of Health.
2. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to execute the Memorandum of Understanding between City of Newark and NBIMC, in order to receive the Grant and file the electronic acceptance necessary to accept the Grant.
3. The Municipal Council hereby ratifies the acceptance the Grant Award from the date that the electronic acceptance was filed to the date of adoption of this authorizing Resolution.
4. The Memorandum of Understanding between City of Newark and NBIMC is hereby ratified from May 23, 2025 to the date of adoption of this authorizing Resolution.
5. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to receive and expend the Grant Award for the provision of medical equipment commencing on March 1, 2025 and terminating on December 31, 2025.
6. No municipal matching funds are required for the receipt or acceptance of the Grant.
7. The Director of the Department of Health and Community Wellness shall file a fully-executed copy of the Grant Award Letter, and Memorandum of Understanding, in the Office of the City Clerk together with this Resolution.
STATEMENT
This Resolution authorizes and ratifies the actions taken by the Mayor and/or his designee, the Director of Health and Community Wellness, to accept grant funds in the amount of Four Hundred Twenty-Four Thousand, Two Hundred Twenty Six Dollars and Seventy -Two Cents ($424,226.72), from Newark Beth Israel Medical Center, to provide medical equipment to help improve health care delivery in the City of Newark, expand infrastructure to enhance access to primary/specialty care, and support community based programs to improve health equity and outcomes, for the period commencing on March 1, 2025 and terminating December 31, 2025. No municipal matching funds are required for the receipt or acceptance of these Grant Funds.
