AN ORDINANCE AMENDING, TITLE XXIII, TRAFFIC, CHAPTER 5, PARKING, STOPPING AND STANDING, GENERALLY, SECTION 5-1, PARKING PROHIBITED AT ALL TIMES AND SECTION 5-2, PARKING PROHIBITED AT CERTAIN TIMES, TO INCLUDE FINES FOR THE VIOLATION THEREOF AND SECTION 5-3.1, PARKING PROHIBITED AT ANY TIME FOR TRUCKS, TRUCK CABS, TRUCK TRAILERS, AND BUSES EXCEEDING FOUR TONS REGISTERED GROSS WEIGHT AND SECTION 5-3.2, PARKING PROHIBITED BETWEEN 11:00 P.M. AND 5:00 A.M. FOR COMMERCIAL VEHICLES, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, TO INCREASE THE FINES FOR VIOLATIONS.

NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

SECTION 1. Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, Section 5-1, Parking Prohibited at All Times, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is amended and supplemented, to read as follows:
Chapter 5, Parking, Stopping and Standing, Generally
§23:5-1. PARKING PROHIBITED AT ALL TIMES.
No person shall park any vehicle at any time upon any of the following streets, portions of streets or designated points: as shown below. The fine for violation of this section shall be $85.00.
SECTION 2. Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, Section 5-2, Parking Prohibited at Certain Times, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is amended and supplemented, to read as follows:

§23:5-2. PARKING PROHIBITED AT CERTAIN TIMES.
No person shall park any vehicle at any time upon any of the following streets, portions of streets or designated points between the hours as specified: as shown below. The fine for violation of this section shall be $85.00.

Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, Section 5-3.1 , Parking Prohibited at Any Time for Trucks, Truck Cabs, Truck Trailers and Buses Exceeding Four Tons Registered Gross Weight, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is amended and supplemented, to read as follows:

§23:5-3. PARKING PROHIBITIONS.
§23:5-3.1. Parking Prohibited at Any Time for Trucks, Truck Cabs, Truck Trailers and Buses Exceeding Four Tons Registered Gross Weight.
c. The fine for violation of this section shall be a minimum of $100 $1,000.00 and not to exceed $2,000 $3,000.00.
SECTION 4. Title XXIII, Traffic, Chapter 5, Parking, Stopping and Standing, Generally, Section 5-3.2, Parking Prohibited Between 11:00 P.M. and 5:00 A.M. for Commercial Vehicles, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is amended and supplemented, to read as follows:

§23:5-3.2. Parking Prohibited Between 11:00 P.M. and 5:00 A.M. for Commercial Vehicles.
e. The fine for violation of this Section shall be a minimum of $100 $1,000.00, but not to exceed $2,000 $3,000.00.
SECTION 5. All City ordinances or parts thereof inconsistent herewith are hereby repealed to the extent of their inconsistency only.
SECTION 6. If any part of this Ordinance shall be declared to be invalid or inoperative, such part shall be deemed severable and the invalidity thereof shall not affect remaining parts of this Ordinance.
SECTION 7. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
SECTION 8. Codification. This Ordinance shall be a part of the Code of the City of Newark as though codified and fully set forth therein. The City Clerk shall have this Ordinance codified and incorporated in the official copies of the Code. The City Clerk and the Corporation Counsel are authorized and directed to change any Chapter, Article and/or Section number of the Code of the City of Newark in the event that the codification of this Ordinance reveals that there is a conflict between the numbers and the existing Code, and in order to avoid confusion and possible accidental repealers of existing provisions not intended to be repealed.
STATEMENT
This Ordinance amends Title XXIII, Traffic, Chapter 5, Section 5-1, Parking Prohibited at All Times and Section 5-2, Parking Prohibited at Certain Times, to include fine for the violation thereof, and Section 5-3.1, Parking Prohibited at Any Time for Trucks, Truck Cabs, Truck Trailers, and Buses Exceeding Four Tons Registered Gross Weight and Section 5-3.2, Parking Prohibited Between 11:00 P.M. and 5:00 A.M. for commercial vehicles, to increase the fine for the violations thereof.
