WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities FY2023 Municipal Aid Program (“NJDOT Municipal Aid Program”) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, on June 25, 2022, the Acting Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the NJDOT Municipal Aid Program for Street Resurfacing - Various Streets - 2023 - Newark within the City of Newark, identified as application MA-2023-VARIOUS STREETS-2023 NEWARK MA-23 - 00582 (the “Project”) for City of Newark with no City funds required; and
WHEREAS, on August 3, 2022, the Municipal Council adopted Resolution 7R3-c authorizing the Acting Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for Contract #2023-06 Municipal Aid Program for Street Resurfacing - Various Streets-2023 - Newark MA-23, NJDOT; and
WHEREAS, on November 23, 2022, NJDOT announced that the City was selected to receive a grant award in the amount of $3,102,131.00 for the construction of Municipal Aid Program for Street Resurfacing - Various Streets-2023 - Newark MA-23; and
WHEREAS, NJDOT requires the City to award the contract for construction of the Municipal Aid Program for Street Resurfacing - Various Streets-2023 - Newark MA-23 within two (2) years of the announcement of the receipt of a grant award; and
WHEREAS, the City of Newark wishes to request a time extension from the NJDOT to allow the City additional time to award the contract for construction of the Project by May 22, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, is hereby authorized to request a time extension from NJDOT to allow the City of Newark to award a contract for construction of Municipal Aid Program for Street Resurfacing - Various Streets-2023 - Newark MA-23 by May 22, 2025.
2. All other terms and conditions of the grant award from the NJDOT for Contract #2023-06 Municipal Aid Program for Street Resurfacing - Various Streets-2023 - Newark MA-23 project shall remain in force and effect until the contract is completed.
STATEMENT
This resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to request a time extension from NJDOT to allow the City of Newark to award a contract for construction of the Municipal Aid Program for Street Resurfacing - Various Streets-2023 - Newark MA-23 by May 22, 2025. No municipal funds are required.
