WHEREAS, the City of Newark Department of Public Safety, Police Division is in need of a data processing service for the tracking of items purchased and sold by secondhand dealers in order to aid the Police Division in the recovery of stolen items and in the apprehension of individuals who steal them; and

 

WHEREAS, the City of Newark Police Division is furthermore in need of a third-party vendor to operate, manage, and administer the above-described data processing service; and

 

WHEREAS, N.J.S.A. 40A:11-4.1(b)(3) authorizes the use of competitive contracting in lieu of public bidding for the procurement of specialized goods and services for the purpose of operation, management, and administration of data processing services; and

 

                     WHEREAS, pursuant to N.J.S.A. 40A:11-4.3(a), in order to initiate competitive contracting, the Municipal Council must pass a resolution authorizing the use of competitive contracting each time specialized goods or services are desired to be contracted; and

 

WHEREAS, the competitive contracting process shall be administered by the Business Administrator, Supervising Procurement Specialist, and the Acting Director of the Department of Public Safety, of the City of Newark pursuant to N.J.S.A. 40A:11-4.3(b), and any contract awarded under this process shall be made by resolution of the Municipal Council.

NOW, THEREFORE, BE IT IS RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council hereby authorizes the Business Administrator, Supervising Procurement Specialist, and the Acting Director of the Department of Public Safety of the City of Newark to use competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure for the Police Division of the City of Newark, the operation, management, and administration of certain data processing services, more specifically, data processing services for the tracking of items purchased and sold by secondhand dealers in order to aid the Police Division in the recovery of stolen items and in the apprehension of individuals who steal them.

 

2.                     The competitive contracting process shall be administered by the Business Administrator, the Supervising Procurement Specialist and the Acting Director of the Department of Public Safety, pursuant to N.J.S.A. 40A:11-4.3(b).

 

3.                     The award of any such contract shall be by resolution of the Municipal Council in accordance with N.J.S.A. 40A:11-4.3(b).

 

STATEMENT

 

This resolution authorizes the use of competitive contracting, pursuant to N.J.S.A. 40A:11-4.1, et seq., to procure, for the Department of Public Safety, Police Division, of the City of Newark, the operation, management, and administration of data processing services for the tracking of items purchased and sold by secondhand dealers in order to aid the Police Division in the recovery of stolen items and in the apprehension of individuals who steal them.
