WHEREAS, the City of Newark’s Department of Health and Community Wellness desires to continue providing lead hazard reduction services in eligible housing units throughout the City of Newark (“City”); and
WHEREAS, the United States Department of Housing and Urban Development (HUD), Office of Lead Hazard Control and Healthy Homes, has funds available for the provision of such services; and
WHEREAS, on or about August 19, 2024, on behalf of the City, the Director of the Department of Health and Community Wellness submitted an application to the U.S. Department of Housing and Urban Development (HUD), 451 Seventh Street, SW, Rm 8236, Washington, DC 20410, requesting grant funding in the amount of Seven Million Seven Hundred Fifty Thousand Dollars and Zero Cents ($7,750,000.00) , for the Lead Hazard & Healthy Homes Reduction Program, to identify and implement cost-effective lead hazard reduction measures to correct lead hazards in eligible housing units throughout the City; and
WHEREAS, as a result of this application, the City has been awarded a grant in the amount of Seven Million Seven Hundred and Fifty Thousand Dollars and Zereo Cents$7,750,000.00, from the United States Department of Housing and Urban Development (HUD), Office of Lead Hazard Control and Healthy Homes, for the Lead Hazard & Healthy Homes Reduction Program, to identify and implement cost-effective lead hazard reduction measures to correct lead hazards in eligible housing units throughout the City, for the period commencing on December 15, 2024 and terminating on December 15, 2028; and
WHEREAS, the grant requires in-kind match from the City in the amount of Seven Hundred Six Thousand Nine Hundred Twenty Five Dollars and Zero Cents ($706,925.00), which will be provided directly from the City, U.S. Department of Housing and Urban Development Community Development Block Grant Program (“CDBG”) and New Jersey Department of Health Childhood Lead Poison Prevention; and
WHEREAS, the City desires to accept funds in the amount Seven Million Seven Hundred and Fifty Thousand Dollars and Zero Cents $7,750,000.00; and
WHEREAS, the City recognizes that the U.S. Department of Housing and Urban Development (HUD), Office of Lead Hazard Control & Healthy Homes, may extend the time of the Grant Award and/or provide additional funds, if made available; and
WHEREAS, the U.S. Department of Housing and Urban Development (HUD), Office of Lead Hazard Control and Healthy Homes, will amend the grant to reflect the extension of the grant period and/or increase or decrease of additional funds if made available; and
WHEREAS, terms of this grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to approval of the Municipal Council be resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness, is hereby authorized to submit an application to the United States Department of Housing and Urban Development (HUD), Office of Lead Hazard Control and Healthy Homes, 451 Seventh Street, SW, Room 8236, Washington, DC 20410, to identify and implement cost-effective lead hazard reduction measures to correct lead hazards in eligible housing units throughout the City of Newark for the period of December 15, 2024 - December 15, 2028 (a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.
3. The grant award in the amount of Seven Million Seven Hundred and Fifty Thousand Dollars and Zero Cents ($7,750,000.00) from the U.S. Department of Housing and Urban Development (HUD) is hereby accepted (a copy of the award is attached hereto and made a part hereof).
4. The grant award requires an in-kind match from the City of Newark in the amount of Seven Hundred Six Thousand Nine Hundred Twenty Five Dollars and Zero Cents ($706,925.00), which will be sourced from the City of Newark, U.S. Department of Housing and Urban Development Community Development Block Grant Program (“CDBG”) and New Jersey Department of Health Childhood Lead Poison Prevention.
5. The Municipal Council hereby ratifies the acceptance of this grant from December 12, 2024, to the date of adoption of this authorizing resolution.
6. The Mayor of the City of Newark, and/or his designee, the Director of the Department of Health and Community Wellness, is hereby authorized to receive and expend the grant.
7. The Director of the Department of Health and Community Wellness shall file a fully executed copy of the grant application and notice of grant in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the Director of the Department of Health and Community Wellness, to apply for and accept grant funding from the U.S. Department of Housing and Urban Development (HUD), 451 Seventh Street, SW, Room 8236, Washington, DC 20410, in the amount of Seven Million Seven Hundred Fifty Thousand Dollars and Zero Cents ($7,750,000.00), with an in-kind match from the City of Newark in the amount of Seven Hundred Six Thousand Nine Hundred Twenty Five Dollars and Zero Cents ($706,925.00), to identify and implement cost-effective lead hazard reduction measures to correct lead hazards in eligible housing units throughout the City of Newark, for the period commencing on December 15, 2024 and terminating on December15, 2028 .
