WHEREAS, the City of Newark, Department of Health and Community Wellness (“DHCW”) has expended and continues to expend funds to provide Local Health Department (“LHD”) related services during the ongoing COVID-19 Public Health Emergency and pandemic; and 

 

WHEREAS, the New Jersey Association of County and City Health Officials (“NJACCHO”) has made funds available for LHD expenditures directly related to the ongoing COVID-19 pandemic; and

 

WHEREAS, NJACCHO agrees to reimburse DHCW retroactively, from January 20, 2020 through February 21, 2021, for COVID-19 LHD related expenses, and continue such reimbursement until the specified population-based funding limit of One Hundred Sixty-One Thousand Seven Hundred Ninety-Seven Dollars and Zero Cents ($161,797.00) is reached; and  

 

WHEREAS, the DHCW agrees to submit invoices for COVID-19 LHD related expenditures, for which the City seeks reimbursement from NJACCHO; and

 

WHEREAS, NJACCHO agrees to work closely with the DHCW and the New Jersey Department of Health (“NJDOH”) to resolve any payment discrepancies, should they arise, in a timely manner; and

WHEREAS, the DHCW accepts funds from NJACCHO as reimbursement for LHD COVID-19 related expenditures, at no cost to the City of Newark; and

 

 

WHEREAS, the DHCW shall demonstrate compliance with both N.J.A.C. 8:52-3.3 and N.J.A.C. 8:52-4.1 (a), keeping CDRSS up to date for COVID-19 cases within its jurisdiction; and

 

WHEREAS, as a condition of reimbursement the DHCW agrees to any modifications to this reimbursement program as may be imposed upon the NJAACHO by the NJDOH; and

 

WHEREAS, as a condition of reimbursement the DHCW agrees not to submit the same expenses through any other channels including other NJDOH grants and the FEMA reimbursement process; and

 

WHEREAS, the DHCW shall work closely with the NJACCHO's designee and NJDOH to resolve any payment discrepancies in a timely manner; and

 

WHEREAS, the DHCW shall adhere to NJACCHO deadlines for reimbursement submission(s).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to enter into an agreement and accept reimbursement funds for COVID-19 related expenses from the New Jersey Association of County and City Health Officials (NJACCHO), whose principal place of business is P.O. Box 6987, Freehold, New Jersey 07728, for Local Health Department (LHD) costs directly related to the COVID-19 response for the period commencing January 20, 2020 through February 21, 2021 (“ Letter of Agreement”) (a copy of the Letter of Agreement is attached hereto and made a part hereof).

 

2.                     The Municipal Council hereby ratifies this Letter of Agreement from January 20, 2020 to the date of the adoption of this authorizing resolution.

 

3.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to accept from NJACCHO the eligible reimbursement funds, LHD costs, up to an amount of One Hundred Sixty-One Thousand Seven Hundred Ninety-Seven Dollars and Zero Cents ($161,797.00). Acceptance of reimbursement funds does not require the expenditure of any municipal funds. 

 

4.                     The Director of the Department of Health and Community Wellness shall file with the Office of the City Clerk a fully executed copy of the Agreement with NACCHO.

 

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Health and Community Wellness to execute a Letter of Agreement and accept reimbursement funds from the New Jersey Association of County and City Health Officials (NJACCHO), located at P.O. Box 6987, Freehold, New Jersey 07728, in the amount of up to $161,797.00, for Local Health Department (LHD) expenses directly related to the COVID-19 pandemic, for the period commencing on January 20, 2020 through February 21, 2021. The acceptance of NJACCHO COVID-19 reimbursement funds does not require the expenditure of any municipal funds.
