WHEREAS, on behalf of the City of Newark, the Police Director submitted an application to the U.S. Department of Justice - Bureau of Justice Assistance, requesting funding in the amount of $471,820.00 from the FY2013 Edward Byrne Memorial Justice Grant Local Program to fund police overtime initiatives to address violent crime and a firearms training simulator with no City funds required; and
 
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
 
      WHEREAS, the City of Newark has received notification of receipt of the grant award in connection with this application, and the Police Director desires to accept the grant award and execute a grant agreement governing said award; and
 
           WHEREAS, the City of Newark has received notification of receipt of the grant award in connection with this application and the Police Director is submitting a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature; and
 
           WHEREAS, the City of Newark, as largest of the Essex County Municipalities, shall be the lead applicant and shall be responsible for administration of the funds including distribution of the funds, monitoring the award, submitting progress reports, and providing ongoing assistance to sub-recipients of the funds; and
 
WHEREAS, the Police Department has been awarded grant funding in the amount of $471,820.00 from the 2013 Edward Byrne Memorial Justice Assistance Grant Local Program to be distributed among several municipalities within Essex County New Jersey for the purpose of implementing strategies to prevent and control crime with no City funds required; and
 
WHEREAS, a Memorandum of Agreement among the participating municipalities, represented by their respective law enforcement Executive, has allocated funding as per the following schedule:  Newark = $276,537.40, Irvington = $83,801.40, East Orange = $44,721.25, Orange = $32,265.80, Bloomfield = $10,903.15 and, lead applicant administrative expenses = $23,591.00; and
 
WHEREAS, the City of Newark desires to fund police overtime initiatives to address violent crime.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Police Director, are hereby authorized to enter into a Memorandum of Understanding with the participating municipalities of Essex County, New Jersey and submit an application to the U.S. Department of Justice requesting grant funding in the amount of $471,820.00 from the 2013 Edward Byrne Memorial Justice Assistance Grant Local Program for the purpose of implementing strategies to prevent and control crime with no City funds required (a copy of the application is attached hereto and made a part hereof).
    2. The Municipal Council hereby ratifies authorization of this application and the Memorandum of Understanding from the date of submission of the application to the date of adoption of this authorizing resolution.
    3. The Mayor and/or his designee, the Police Director are hereby authorized to accept the allocation from the U.S. Department of Justice requesting grant funding in the amount of $471,820.00.
    1. The Mayor and/or his designee, the Police Director, are hereby authorized to enter into and execute the grant documents with the U.S. Department of Justice to receive and expend the 2013 Edward Byrne Memorial Justice Assistance Grant Local Program grant award for the purpose of implementing strategies to prevent and control crime.
    2. The Municipal Council hereby ratifies the execution of the Memorandum of Understanding from the date of execution to the date of adoption of this resolution.
    1. The Police Director shall submit a complete copy of grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
    2. No municipal funds are required for receipt or acceptance of this grant award.
    1. The Police Director shall file a fully-executed copy of the 2013 Edward Byrne Memorial Justice Assistance Grant Local Program application, the grant award letter, and the grant agreement in the Office of City Clerk.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Police Director to submit an application for, accept, and enter in an agreement for the 2013 Edward Byrne Memorial Justice Assistance Grant Local Program for funding in the amount of $471,820.00 from the U.S. Department of Justice for the purpose of implementing strategies to prevent and control crime.  No municipal funds are required.
