WHEREAS, as part of its mission to promote public art, community engagement, and neighborhood revitalization, the City seeks to coordinate the installation of a public mural (the “Mural”) on the façade of a property located at 1060 Mayor Kenneth A. Gibson Boulevard in Newark, New Jersey (the “Property”); and
WHEREAS, Essex Plaza Owner One, LLC, the owner of the Property, desires to permit the installation of the Mural on the façade of the said Property, provided that the Mural’s installation, maintenance, and removal does not interfere with the owner’s use, enjoyment, or operation of the Property, and will be conducted in a manner that protects the owner’s interests; and
WHEREAS, the City and the owner desire to set forth their mutual understandings with respect to the installation, maintenance, and removal of the Mural in a Memorandum of Understanding; and
WHEREAS, the Parties acknowledge that the Mural’s installation will be temporary.
Now, therefore, be it resolved by the Municipal Council of the City of Newark, New Jersey, that:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute the attached Memorandum of Understanding (MOU) with Essex Plaza Owner One, LLC, 1060 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey 07102, in connection with the installation of a mural on façade of the property located at 1060 Mayor Kenneth A. Gibson Boulevard in Newark, New Jersey.
2. No substantial or material changes to the MOU may occur without the Municipal Council’s prior approval.
3. The Deputy Mayor/Director of the Department of Economic and Housing Development shall cause a copy of the fully executed MOU to be filed in the Office of the City Clerk and made available for public inspection.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to execute the Memorandum of Understanding (MOU) Essex Plaza Owner One, LLC in connection with the installation of a mural on the property located at 1060 Mayor Kenneth A. Gibson Boulevard in Newark, New Jersey .
