WHEREAS, the Clean Communities Program Act, N.J.S.A. 13:1E-213, et seq. (the “Act”), established a Clean Communities Program Fund administered by the New Jersey Department of Environmental Protection (“NJDEP”), from which grants may be made to municipalities in order to encourage increased anti-litter campaigns; and

 

WHEREAS, the City of Newark (the “City”) is eligible, without application, to receive an annual grant under the Act to create or to supplement an existing litter reduction program within the Municipality; and

 

WHEREAS, the City desires to further the public interest by obtaining funding from the Clean Communities Program Fund with the intent of the Act to use the grants to develop new Municipal anti-litter programs and to continue and expand existing programs; and

 

WHEREAS, in order to receive and accept Clean Communities Program funds, recipient Municipalities are required to comply with the requirements of the Act and the Clean Communities Program Guidelines (“Guidelines”).  (A copy of the Guidelines are attached hereto and made a part of this resolution). 

 

WHEREAS, according to the Guidelines, acceptance of the Clean Communities Program funds requires the City of Newark to maintain program efforts and utilize funds for the following purposes: (1) litter clean-up and removal, (2) education programs to promote clean communities, (3) graffiti abatement, and (4) enforcement of local anti-littering laws; and

 

WHEREAS, the City has implemented such clean community program efforts; and

 

WHEREAS, it is the desire of the City to continue said clean community program efforts in order to provide a clean, litter free environment for its citizens; and

 

WHEREAS, on May 27, 2022 the City was awarded a grant in the amount of $453,723.62 from the State of New Jersey, Department of Environmental Protection, NJ Clean Communities Council, which, according to the Guidelines, must be utilized during the eighteen (18) month period beginning on January 1, 2022 and ending on June 30, 2023, with no expenditure of City funds or resources required; and

 

WHEREAS, the Director of the Department of Public Works submitted a letter to the NJDEP requesting an extension of time to expend the above grant funds from the NJDEP until December 31, 2023; and

 

WHEREAS, the Department of Public Works wishes to accept the Clean Communities Program funds and expend them according to the Act and the Guidelines, for the purpose of removal and abatement of graffiti with in the City of Newark.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The FY 2022 grant award in the amount of $453,723.62 from the NJ Clean Communities Council (a copy of the check is attached hereto and made a part hereof) is hereby accepted.

 

2.                     The Mayor of the City of Newark and/or his designee, the Director of the Department of Public Works, are hereby authorized to enter into and execute grant documents with New Jersey Clean Communities Council, administered by the New Jersey Department of Environmental Protection, as may be required to receive and expend the FY 2022 grant award in the amount of $453,723.62 to carry out the above-referenced program efforts as set forth in the Clean Communities Program Guidelines (the “Guidelines”) attached hereto and made a part of this resolution, for the period commencing January 1, 2022 and terminating on June 30, 2023.

 

 

3.                     The Municipal Council hereby ratifies acceptance of this grant from January 1, 2022 until the date of adoption of this authorizing Resolution.

 

4.                     The Municipal Council hereby ratifies and authorizes the Director of the Department of Public Works to submit a letter to the NJDEP requesting an extension of time to expend the above grant funds from the NJDEP until December 31, 2023.

 

 

5.                     The Department of Public Works will be responsible for the NJ Clean Communities Council program’s implementation, and the Director of the Department of Public Works is hereby designated as the Clean Community Coordinator.

 

6.                     No municipal funds are required for receipt or acceptance of the grant award.

 

7.                     The Director of the Department of Public Works shall file a fully executed copy of the grant agreement and any other associated grant documentation, to the extent they are required under this program in the Office of the City Clerk.

 

 

STATEMENT

 

This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Public Works, to enter into and execute an agreement for the acceptance of grant funds in the amount of $453,723.62 from the Clean Communities Program for programs of litter pick up and removal, as well as for abatement of graffiti, for the calendar year 2022, commencing on January 1, 2022 and terminating on June 30, 2023, unless an extension is given by the State of New Jersey. This resolution further ratifies and authorizes the Director of the Department of Public Works to submit a letter to the NJDEP requesting an extension of time to expend the above grant funds from the NJDEP until December 31, 2023. Funding will be used to supplement an existing Litter Reduction Program for the removal and abatement of graffiti with in the City of Newark. No municipal funds are required for the receipt or acceptance of the grant award.
