WHEREAS, the City of Newark, Department of Public Safety, Police Division and the Newark Housing Authority entered into a Memorandum of Understanding (MOU) for Shared Services to provide the following: patrol within the NHA residential sites, provide additional enforcement within the NHA residential sites, provide safety and security for NHA residents and staff, educate, enforce, and encourage residents about COVID-19 protocols and social distancing orders; and
WHEREAS, the City of Newark (the “City”), is committed to ensuring public safety through the coordination of resources and spirit of cooperation that exists with the Newark Housing Authority; and
WHEREAS, the City of Newark, Department of Public Safety, Police Division shall provide two (2) Police Officers and motor transportation to patrol the properties of the NHA from June 23, 2021 through December 21, 2021, for (3) three (8) eight hour shifts, in accordance with the agreed tour schedule; and
WHEREAS, the City of Newark, Department of Public Safety, Police Division, shall provide the NHA with any and all documentation needed by the NHA in applying for reimbursement of funding spending consistent with this Agreement; and
WHEREAS, the selection of the NHA properties to patrol will be made by the NHA’s Director of Public Safety in consultation with the City’s Director of Public Safety; and
WHEREAS, each party will be responsible for supervision of its own employees performing service’s under this Agreement; and
WHEREAS, as part of this joint nine (9) month initiative, NHA shall apply for reimbursement of funds from all available sources; and
WHEREAS, the total amount of the contract shall not exceed Six Hundred Twenty-Seven Thousand Six Hundred Nine Dollars and Sixty Cents ($627,609.60) based on upon the services of two (2) police officers for three (3) eight (8) shifts. NHA shall contribute to the City for the performance of the services under this MOU in current funds, in an amount not to exceed Five Hundred Thousand Dollars and Zero Cents ($500,000.00); and
WHEREAS, the purpose of this MOU is to delineate the responsibilities of the NHA and the City and its Police Division to maximize inter-agency cooperation and formalize relationships between the parties.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee(s), the Business Administrator and/or the Director of the Department of Public Safety, are hereby authorized to enter into and execute the Shared Service Agreement with the Newark Housing Authority, 500 Broad Street, Newark, New Jersey 07102 to provide two (2) police officers to serve as Social Distancing Ambassadors and to ensure the safety and protection of Newark Housing Authority residents in light of COVID-19, for an amount not to exceed Six Hundred Twenty-Seven Thousand Six Hundred Nine Dollars and Sixty Cents ($627,609.60) for a term of June 23, 2021 through December 31, 2021; Five Hundred Thousand Dollars ($500,00.00) to be reimbursed by NHA to the City which may be extended by the parties subject to Municipal Council approval.
2. The Agreement is ratified from June 23, 2021, to the date of adoption of this authorizing resolution.
3. The Director of the Department of Public Safety, is authorized to submit such appropriate documentation that the Newark Housing Authority and the Department of Finance and the Department of Public Safety agree upon so that Newark Housing Authority may issue payment to the City of Newark, upon receipt of the invoice covering the overtime of the police officers. The amount of overtime services to be charged to the NHA shall not exceed Five Hundred Thousand Dollars and Zero Cents ($500,000.00.).
4. The Director of the Department of Finance, is authorized to accept payment (reimbursement) from the Newark Housing Authority, in an amount up to Five Hundred Thousand Dollars and Zero Cents ($500,000.00.), which shall be deposited into revenue code 011-050-0505-A-52580 (NHA). Thereafter, the Director of the Department of Finance and/or the Director of the Office of Management and Budget shall provide the Department of Public Safety with a Budgetary Refund to its overtime budget.
5. The City shall be responsible for an amount up to One Hundred Twenty-Seven Thousand Six Hundred Nine Dollars and Sixty Cents ($127,609.60.) and the cost of providing motor transportation. The funds will be drawn from the Police Division Overtime Budget: 011-190-1902-60060.
6. Pursuant to N.J.S.A. 40A:65-4(b), the Business Administrator and/or the Director of the Department of Public Safety shall file with the City Clerk and the Division of Local Government Services in the New Jersey Department of Community Affairs a copy of the executed Shared Services Agreement.
STATEMENT
This Resolution ratifies and authorizes the action taken by the Mayor of the City of Newark and/or his designee(s), the Business Administrator and/or the Director of the Department of Public Safety, to enter into and execute the Shared Service Agreement with the Newark Housing Authority, 500 Broad Street, Newark, New Jersey 07102 to provide two (2) police officers to serve as Social Distancing Ambassadors and motor transportation to patrol the properties of the Newark Housing Authority to ensure the safety and protection of Newark Housing Authority residents in light of COVID-19, for an amount not to exceed $627,609.60, for a term of June 23, 2021 through December 31, 2021; $500,00.00 to be reimbursed by NHA to the City and the City shall be responsible for an amount up to $127,609.60.
