Additional Information: 

Resolution 7R1-m, adopted by the Municipal Council on September 8, 2024, authorized a contract with Edward Joseph Cologna Productions, Inc., in an amount not to exceed Five Hundred Seventy-Five Thousand Dollars and Zero Cents ($575,000.00) per year for the operation, management, and administration of services for the Government Access Television Studio of the City of Newark.

 

This Resolution authorizes the Department of Administration, Division of Communications, to exercise the final fourth one-year renewal option for the contract for the period September 8, 2026 through September 7, 2027.

 

A Partial Certification of Funds in the amount of Forty-Seven Thousand Five Hundred Dollars and Zero Cents ($47,500.00) is attached.

WHEREAS, on September 8, 2024, the Municipal Council adopted Resolution 7R1-m authorizing the Mayor of the City of Newark and/or his designee, the Business Administrator, and the Purchasing Agent, QPA, to enter into and execute a contract with Edward Joseph Cologna Productions, Inc., 119 Aycrigg Avenue, Passaic, New Jersey 07055, for the operation, management, and administration of services for the Government Access Television Studio of the City of Newark, in an amount not to exceed Five Hundred Seventy-Five Thousand Dollars and Zero Cents ($575,000.00) per year; and

WHEREAS, the contract was publicly advertised by the Division of Central Purchasing and the bid package was made available through the City of Newark's electronic procurement portal to ensure open competition and broad public access; and

WHEREAS, the contract provides for annual renewal options, subject to the approval of the Municipal Council; and

WHEREAS, the Department of Administration, Division of Communications, has determined that it is in the best interest of the City of Newark to exercise the final fourth one-year renewal option for the contract for the period September 8, 2026 through September 7, 2027; and

WHEREAS, this renewal constitutes the final renewal option authorized under the original contract, and upon its expiration no additional renewal options shall remain; and

WHEREAS, all other terms and conditions of the original contract shall remain unchanged and in full force and effect.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Mayor of the City of Newark and/or his designee, the Business Administrator, and the Purchasing Agent, QPA, are hereby authorized to execute the final fourth one-year renewal option with Edward Joseph Cologna Productions, Inc., 119 Aycrigg Avenue, Passaic, New Jersey 07055, for the operation, management, and administration of services for the Government Access Television Studio of the City of Newark, for the contract period September 8, 2026 through September 7, 2027, in an amount not to exceed Five Hundred Seventy-Five Thousand Dollars and Zero Cents ($575,000.00).

 

2.                     This renewal represents the final renewal option authorized under the original contract. Upon expiration of this renewal term on September 7, 2027, the contract shall expire, and no additional renewal options shall remain.

 

3.                     Attached hereto is the Partial Certification of Funds of the Chief Financial Officer indicating that funds in the amount of Forty-Seven Thousand Five Hundred Dollars and Zero Cents ($47,500.00) are available in the 2026 Temporary Budget in Account: NW011-200-2001-96770-B2026. Immediately after the final budget is adopted, a written certification of available funds shall be prepared for the remaining balance attributable to Budget Year 2026 and filed with this resolution. The written certification of funds for budget year 2027 shall certify the availability of funds to be charged to that budget year. The contract shall be subject to the availability and appropriation of funds beyond the temporary budget period and in budget year 2027.

 

4.                     The original contract was awarded through a Fair and Open Process in accordance with the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, the Local Public Contracts Law, N.J.S.A. 40A:11-4.1(k) and N.J.S.A. 40A:11-4.3(a), and the City of Newark Pay-to-Play Ordinance, R.O. 24-22C.1.

 

5.                     A copy of the executed renewal agreement and this Resolution shall be filed with the Office of the City Clerk by the Purchasing Agent.

6.                     Notice of this action shall be published in the official newspaper of the City of Newark in accordance with applicable law.

 

STATEMENT
