ORDINANCE RATIFYING AND AUTHORIZING THE EXECUTION OF A LEASE AGREEMENT BETWEEN HELO HOLDINGS, INC. (LANDLORD), AND THE CITY OF NEWARK DEPARTMENT OF PUBLIC SAFETY (TENANT), FOR THE LEASING OF A PORTION OF A HANGAR AT LANDLORD’S HHI HELIPORT, PURSUANT TO N.J.S.A. 40A:12-3, FOR THE PURPOSE OF STORING THE POLICE DIVISION HELICOPTER KNOWN AS ABLE-1, FOR THE PERIOD OF JANUARY 1, 2017 TO DECEMBER 31, 2017, FOR THE TOTAL ANNUAL SUM OF $7,200.00 PLUS MONTHLY COSTS FOR UTILITIES.

WHEREAS, the City of Newark is a non-profit corporation of the State of New Jersey, has tax exempt status with respect to the State of New Jersey and the federal government; and
WHEREAS, Helo Holdings, Inc. is the owner of a HHI Heliport, located at 165 Western Road, Kearny, New Jersey 07032; and
WHEREAS, pursuant to N.J.S.A. 40A:12-3, the City of Newark, Department of Public Safety, wishes to enter into a Lease Agreement with Helo Holdings, Inc., to lease a portion of a hangar at Landlord’s HHI Heliport for the purpose of parking its Police Helicopter, identified as ABLE-1, for a period beginning on January 1, 2017 and ending on December 31, 2017.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Public Safety Director are hereby authorized to enter into the Lease Agreement, in the form attached hereto, on behalf of the City of Newark, Tenant, with Helo Holdings, Inc., 165 Western Road, Kearny, New Jersey 07032 Landlord, pursuant to N.J.S.A. 40A:12-3, for the use of a portion of a hangar at Landlord’s HHI Heliport for the purpose of parking its Police Helicopter, identified as ABLE-1, for a period beginning on January 1, 2017 and ending on December 31, 2017.
2. This lease is ratified from January 1, 2017 until the date of adoption of this authorizing Ordinance.
3. The City of Newark shall, as consideration for the said Lease Agreement, pay the Landlord the sum of $7,200.00 for the twelve-month term, to be paid in equal installments of $600.00 due on the first day of each month.
4. The City of Newark is responsible for the monthly cost of Utilities for the term of the lease.
5. Both, the Landlord, Helo Holdings, Inc., and the City of Newark, Public Safety Director, shall be responsible for the enforcement and compliance of the covenants and conditions of the Lease Agreement.
6. Attached hereto is the Comptroller’s Certification, which states that there are available, legally appropriated funds for the purpose set forth hereinabove and that the line item appropriation of the official budget, which shall be charged, is as follows:

7. A copy of the Lease Agreement is attached hereto.
8. A copy of this Ordinance, the Lease Agreement, and the Certification of Funds shall be permanently filed in the Office of the City Clerk by the Public Safety Director.
9. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
This Ordinance ratifies and authorizes the Mayor and/or his designee, the Public Safety Director, to enter into and execute a Lease Agreement, on behalf of the City of Newark, Tenant, with Helo Holdings, Inc., Landlord, pursuant to N.J.S.A. 40A:12-3, for the use of a portion of a hangar at Landlord’s HHI Heliport for the purpose of parking its Police Helicopter, identified as ABLE-1, for a period beginning on January 1, 2017 and ending on December 31, 2017, for an annual rent of $7,200.00 plus monthly cost for Utilities.
