WHEREAS, the City of Newark, Office of Emergency Management and Homeland Security request to have a two part training course. This first part includes a three (3) day training covering IMS 100, 700, and 800. The second part includes one (1) eight hour Exercise Scenario in the City of Newark at The Emergency Operations Center (EOC) located at 480 Clinton Avenue, 3rd Floor, Newark New Jersey 07108 ; and
WHEREAS, the City of Newark, was awarded $200,000.00 from the FY ’14 Urban Areas Security Initiative grant for training purpose by the New Jersey Office of Homeland Security and Preparedness which shall fund this procurement (a copy is attached); and
WHEREAS, the City of Newark, accepted the Urban Areas Security Initiative Grant funds from the NJ Office of Homeland Security and Preparedness by Resolution number 7R1-n, dated December 3, 2014; and
WHEREAS, the State 2004 Appropriations Act, P.L.2004, c.71, and as described by the Division of Local Government Services in Local Finance Notice 2004-21 allows local units to purchase goods and services from certain federal government contracts without the requirement for public bidding pursuant to the Local Public Contracts Law, and, through this resolution and properly executed contracts, the City of Newark plans to use such contracts to purchase goods to meet the requirements of the grant; and
WHEREAS, the Director of Office of Emergency Management and Homeland Security concludes that bidding is not practicable in order to meet acquisition timing or other criteria appropriate to the circumstances; and
WHEREAS, the desired items are not available through a state contract or other in-state procurement; and
WHEREAS, Texas A&M Engineering Extension Service, Inc. (TEEX) has asserted that it is qualified by its experience and reputation in the field to provide the training in the manner and of the terms and conditions set forth in the Government Services Administration (GSA) contract; and
WHEREAS, the Director of the Office of Emergency Management and Homeland Security desires to provide these training courses from federal General Services Administration contractor; and
WHEREAS, N.J.S.A. 52:34-10.6 (c) authorizes the City to purchase goods/services paid for or reimbursed by federal funds awarded by the U. S. Department of Homeland Security without public bidding if the contractor either (1) is a holder of a current State contract for the equipment, or (2) is participating in a federal procurement program established by a federal department or agency, or (3) has been approved by the State Treasurer in consultation with the New Jersey Domestic Security Preparedness Task Force; and
WHEREAS, TEEX is participating in a federal procurement program and has the Government Services Administration (GSA) federally assigned contract numbers GS-07F-0357V and GS02F-003P for the desired training services.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of Emergency Management and Homeland Security, are authorized to procure services and execute a Memorandum of Agreement with Texas A&M Engineering Extension Service, Inc, (TEEX), a member of Texas A&M University Emergency System, Emergency Operations Training Center, 200 Technology Way, College Station, Texas 77845, through a GSA contract to provide a three (3) day training covering IMS 100, 700, & 800 and one (1) eight hour Exercise Scenario in the City of Newark at The Emergency Operations Center (EOC), for the period September 26, 2015 through July 31, 2016, for an amount not to exceed $200,000.00.
2. The contract is ratified from September 26, 2015 to the date of adoption.
3. There shall be no amendment of this resolution without the approval of the Municipal Council.
4. A Certification of Funds which states that there are sufficient available legally appropriated funds for the purposes stated herein is attached.
5. The Director of the Office of Emergency Management and Homeland Security shall file a fully-executed copy of the contract with the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Office of Emergency Management and Homeland Security to procure services and execute a Memorandum of Agreement with Texas A&M Engineering Extension Service (TEEX), a GSA contract, to provide the City of Newark with a three (3) day training covering IMS 100, 700, & 800, and one (1) eight hour Exercise Scenario, for the period commencing September 26, 2015 through July 31, 2016, for an amount not to exceed $200,000.00.
