            WHEREAS, the City of Newark, Department of Economic & Housing Development advertised for the receipt of bids for Contract 07-2012 [Demolition and Asbestos Abatement of Buildings J and K only of the former Orbis Site, 55 Virginia Street, Newark, New Jersey  07114] in accordance with the requirements of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. (the "LPCL"); and
 
      WHEREAS, the bid documents issued by the City of Newark, Department of Economic & Housing Development for Contract 07-2012 [Demolition of the former Orbis Site, 55 Virginia Street, Newark, New Jersey  07114] advised all prospective bidders that the City could award a contract for the demolition and asbestos abatement of any or all of the buildings on the former Orbis site as well as for any or all of the alternates identified within the bid documents; and
 
WHEREAS, the bid advertisement required sealed bids to be submitted on Wednesday, April 25, 2012 by no later than 10:00 a.m. (the "Bid Opening Date"); and
 
      WHEREAS, five bidders submitted bids for Contract 07-2012 [Demolition of the former Orbis site, 55 Virginia Street, Newark, New Jersey  07114] to the City of Newark, Department of Economic & Housing Development on the Bid Opening Date; and
 
      WHEREAS, after reviewing the bids submitted for Contract 07-2012 [Demolition of the former Orbis site, 55 Virginia Street, Newark, New Jersey  07114], the City of Newark, Department of Economic & Housing Development recommends the award of a contract for the demolition and asbestos abatement of Buildings J and K only at Former Orbis Site, 55 Virginia Street, Newark, New Jersey  07114  and for Alternates 1 through 6 as identified within the bid documents; and
 
      WHEREAS, Tricon Enterprises, Inc., 322 Beers Street, Keyport, New Jersey 07735-1418, was the lowest responsible bidder for the demolition and asbestos abatement of Buildings J and K only at Former Orbis Site, 55 Virginia Street, Newark, New Jersey  07114 and for Alternates 1 through 6 as identified within the bid documents; and
 
      WHEREAS, the City of Newark, Department of Economic & Housing Development wishes to accept the bid submitted by Tricon Enterprises, Inc. and to execute Contract 07-2012 [Demolition of the former Orbis site, 55 Virginia Street, Newark, New Jersey  07114] with Tricon Enterprises, Inc. for the demolition and asbestos abatement of Buildings J and K only at Former Orbis Site, 55 Virginia Street, Newark, New Jersey and for Alternates 1 through 6 as identified within the bid documents for a not to exceed amount of $505,150.00; and
 
      WHEREAS,  two certifications  of funds have been provided indicating that the not to exceed amount of $505,150.00 is available and certified for this contract; and
 
      WHEREAS, public bidding in accordance with the Local Public Contracts Law, N.J.S.A. 40A;11-1 et seq, meets the requirements of the fair and open process of the State Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
 
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
      1.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic & Housing Development, are authorized to accept the bid submitted by the lowest responsible bidder, Tricon Enterprises, Inc., 322 Beers Street, Keyport, New Jersey 07735-1418, and to execute Contract 07-2012 [Demolition and asbestos abatement of the former Orbis Site, 55 Virginia Street, Newark, New Jersey  07114] with Tricon Enterprises, Inc. for the demolition and asbestos abatement of Buildings J and K only and for Alternates 1 through 6 as identified within the bid documents for an amount not to exceed $505,150.00.
 
      2.      Attached hereto  are two certifications of funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $505,150.00for the purposes set forth herein.  A copy of the certifications of funds shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic & Housing Development.   The line appropriations of the official budget which shall be charged are as follows:

      3.      A fully executed copy of this contract and Notice to Proceed shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic & Housing Development.
 
      4.      The work covered by this contract is to be completed within a period of seven (7) months from the date of issuance of a Notice to Proceed by the DeputyMayor/Director of the Department of Economic and Housing Development.  
      5.      This contract is being awarded pursuant to the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., and is in compliance with the State Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5 et seq., under the "fair and open" process and is exempt from Executive Order #MEO-007-0001, issued March 31, 2007, because it is a publicly bid contract.
 
      6.      There shall be no advance payments against this contract pursuant to N.J.S.A. 40A:5-16.
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic & Housing Development, to accept the bid submitted by the lowest responsible bidder Tricon Enterprises, Inc., 322 Beers Street, Keyport, New Jersey 07735-1418, and to execute Contract 07-2012 [Demolition and asbestos abatement of the former Orbis site, 55 Virginia Street, Newark, New Jersey  07114] with Tricon Enterprises, Inc. for the demolition and asbestos abatement of Buildings J and K only and for Alternates 1 through 6 as identified within the bid documents for a not to exceed amount of $505,150.00.
