WHEREAS, New Jersey Institute of Technology (“NJIT”) wishes to donate to the City of Newark, Mayor’s Office of Homeless Services, one (1) Security Booth Pod to Hope Village II Housing Initiative, with a total value of Twelve Thousand Dollars and Zero Cents ($12,000.00) to provide security services for homeless individuals residing at Hope Village II; and
WHEREAS, pursuant to Local Public Contracts Law, N.J.S.A. 40A:5-29, a local unit is authorized and empowered to accept bequests, legacies and gifts made to it and is empowered to utilize such bequests, legacies and gifts in the manner set forth in the conditions of the bequest, legacy or gift provided, however, that such bequest, legacy, or gift shall not be put to any use which is inconsistent with the laws of the State of New Jersey and the United States of American; and
WHEREAS, pursuant to N.J.S.A. 40A:5-29, the Homelessness Czar for the City of Newark (the” City”), Department of Administration, Office of Homeless Services, wishes to accept the donation of one (1) Security Booth Pod for the benefit of Hope Village II Housing Initiative, with a total value of Twelve Thousand Dollars and Zero Cents ($12,000.00), which will provide security services for homeless individuals residing at Hope Village II; and
WHEREAS, to accept the gift, NJIT requires the City to execute a one (1) Security Booth Pod Donation Agreement (attached hereto); and
WHEREAS, NJIT fully understands and agrees that it is not entitled to receive any direct benefit from the City in exchange for its gift; and
WHEREAS, the Office of Homeless Services has represented they shall be responsible for coordinating with the Department of Administration and/or the Department of Public Works, regarding arrangement for pickup and delivery of the Shelter Booth Pod from NJIT to Hope Village II, at no additional cost for the transport of the Shelter Booth Pod.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator and/or the Homelessness Czar for the Office of Homeless Services, are hereby authorized to accept a gift of one (1) Security Booth Pod from New Jersey Institute of Technology (NJIT), pursuant to N.J.S.A. 40A:5-29.
2. The City shall execute the Security Booth Pod Donation Agreement (the “Agreement”) with NJIT prior to accepting the gift.
3. The gift has a value of Twelve Thousand Dollars and Zero Cents ($12,000.00), which is the value of the labor to construct and build the Pod.
4. The Pod will benefit the chronically homeless population residing at Hope Village II by providing a space for security services.
2. No municipal funds will be expended in the acceptance of this gift.
3. The Office of Homeless services shall be responsible for coordinating the transport of the Shelter Booth Pod.
4. The fully executed Agreement with NJIT shall be filed in the Office of the City Clerk by the Homelessness Czar of the Office of Homeless Services.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Business Administrator, and/or the Homelessness Czar for the Office of Homeless Services, to accept the gift of one (1) Security Booth Pod from New Jersey Institute of Technology, Weston Hall, 375 Martin Luther King Boulevard, Newark, New Jersey 07102, and execute the Security Booth Pod Donation Agreement, for Hope Village II to provide emergency housing for chronically homeless individuals. This gift is valued at Twelve Thousand Dollars and Zero Cents. No municipal funds are required for acceptance of this gift.
