WHEREAS, on May 16, 2013 the City of Newark advertised for the receipt of sealed bids for Contract 06-WS2013 for PROVIDING ONE (1) 2012 or latest model 9 FOOT DUAL WHEEL SERVICE BODY WITH VALVE MACHINE, TRAV-L-VAC AND ACCESSORIES and ONE (1) E.H WACHS LX VALVE MAINTENANCE TRAILER OR APPROVED EQUAL, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, on June 4, 2013, the scheduled date for the public opening of bids, four (4) bids were received; and
WHEREAS, after a review of the bids received, the Acting Director of the Department of Water and Sewer Utilities, has determined that it is in the best interest of the City of Newark to accept the bid proposal and execute Contract 06-WS2013 with DFFLM, LLC. T/A DITSCHMAN/FLEMINGTON FORD LINCOLN MERCURY, 215 Routes 202 and 31, Flemington, New Jersey 08822, the lowest responsible bidder according to the specifications, for the total bid amount of $209,569.00; and
WHEREAS, the public bidding process, in accordance with the Local Public Contracts Law, N.J.S.A.40A:11-1, et seq.; constitutes a Fair and Open Process in accordance with New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and is in compliance with the City of Newark Executive Order and Pay-to-Play (MEO-07-0001); and
WHEREAS, DFFLM, LLC. T/A DITSCHMAN/FLEMINGTON FORD LINCOLN MERCURY, 215 Routes 202 and 31, Flemington, New Jersey 08822 has accepted the responsibility to file an annual disclosure statement on political contributions with the New Jersey Election Law Enforcement Commission pursuant to N.J.S.A. 19:44A-20.13 (P.L.2005, Ch. 271,s.3) if the contractor receives contracts in excess of $50,000.00 from public entities in a calendar year.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee the Acting Director of the Department of Water and Sewer Utilities are hereby authorized on behalf of the City of Newark to accept the bid submitted by the lowest responsive and responsible bidder on June 4, 2013, DFFLM, LLC. T/A DITSCHMAN FLEMINGTON FORD LINCOLN MERCURY, 215 Routes 202 and 31, Flemington, New Jersey 08822, and execute Contract 06-WS2013 "PROVIDING ONE (1) 2012 or latest model 9 FOOT DUAL WHEEL SERVICE BODY WITH VALVE MACHINE, TRAV-L-VAC AND ACCESSORIES and ONE (1) E.H WACHS LX VALVE MAINTENANCE TRAILER OR APPROVED EQUAL" for the certified amount of $209,569.00, for the period of 300 calendar days from the date of contract execution.
2. Attached hereto is a certification of funds issued by the Municipal Comptroller of the City of Newark, which states that (1) there are available sufficient legally appropriated funds for the purposes set forth here in above and (2) that the line appropriation of the official budget which shall be charged is.

3. There shall be no amendment or change to the contract without approval by the Newark Municipal Council.
4. There shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
5. A fully executed copy of the contract and the certification of funds shall be filed in the Office of the City Clerk by the Acting Director of the Department of Water and Sewer Utilities.
6. This public bidding process pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq. constitutes the Fair and Open process defined in the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and is in compliance with the City of Newark Executive Order and Pay-to-Play (MEO-07- 001).
STATEMENT
This resolution authorizes the Mayor and/or his designee the Acting Director of the Department of Water and Sewer Utilities to accept the bid submitted by the lowest responsive and responsible bid submitted on June 4, 2013, DFFLM, LLC. T/A DITSCHMAN FLEMINGTON FORD LINCOLN MERCURY, 215 Routes 202 and 31, Flemington, New Jersey 08822 and enter into and execute Contract 06-WS2013 "PROVIDING ONE 9 FOOT DUAL WHEEL SERVICE BODY WITH VALVE MACHINE, TRAV-L-VAC AND ACCESSORIES and ONE E.H WACHS LX VALVE MAINTENANCE TRAILER OR APPROVED EQUAL" for the certified amount of $209,569.00 for the period of 300 calendar days from the date of contract execution.
