WHEREAS, on May 16, 2025, the City of Newark through its Purchasing Agent, QPA, advertised soliciting proposals for contractors to provide a One Stop Career Center Operator for the Newark Workforce Development Board, as described in the attached Request for Proposals (“RFP”) package; and
WHEREAS, the Division of Central Purchasing published the RFP on the City’s electronic procurement portal to provide broader access and download capability to potential bidders; and
WHEREAS, via the electronic procurement portal, twenty-six (26) RFP packages were downloaded by prospective vendors following the date of advertisement; and
WHEREAS, on June 5, 2025, the Division of Central Purchasing received one (1) proposal in response to this advertisement; and
WHEREAS, pursuant to the competitive contracting process, a three (3)-member evaluation committee (“Proposal Review Committee”) was formed to review the proposal and to make a recommendation, as outlined in the specifications; and
WHEREAS, the Purchasing Agent obtained signed, no-conflict letters from the members of the Proposal Review Committee (copies of which are attached hereto) before releasing the RFP response to the evaluators via the electronic procurement portal; and
WHEREAS, the Proposal Review Committee evaluated the single response from
Newark WORKS, 375 McCarter Highway, 3rd Floor, Newark, New Jersey 07114 (Newark WORKS) in accordance with the evaluation criteria stated in the RFP; and
WHEREAS, the Proposal Review Committee made its recommendation to the Purchasing Agent to make an award to Newark WORKS based on their proposal being the sole submission and in the best interest of the City of Newark, cost and other factors considered, given the RFP criteria; and
WHEREAS, the Purchasing Agent concurs with the evaluation committee’s recommendation; and
WHEREAS, this contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and/or the Purchasing Agent, are hereby authorized to enter into a contract with Newark WORKS, 375 McCarter Highway, 3rd Floor, Newark, New Jersey 07114, to provide services as a One Stop Career Center Operator for the City of Newark based on the recommendation of the Proposal Review Committee established to evaluate the proposals. The contract term shall be for a period not to exceed twenty-four (24) consecutive months, with two (2) one-year options to renew.
2. The contract amount shall not exceed Two Hundred Forty Thousand Dollars and Zero Cents ($240,000.00). Attached hereto the Finance Director’s Partial Certification of Funds stating that funds in the amount of $____________ are available in the 2025 Temporary Budget in account number: Bus. Unit _________/Dept. ___/ Div.________/ Acct # _______________ for the purposes stated in this Resolution. Pursuant to N.J.A.C. 5:30-5.5(a)(2), immediately after the 2025 Final Budget is adopted, a written certification of available funds shall be prepared for the remaining balance and filed with this Resolution. Pursuant to N.J.A.C. 5:30-5.5(d)(1)(ii), in subsequent fiscal years, a written certification of available funds shall certify the availability of all funds to be charged to the budget for that fiscal year. The contract authorized by this Resolution shall be subject to the availability and appropriation annually of sufficient funds both in the 2025 Final Budget and in each subsequent fiscal year.
3. The Municipal Council of the City of Newark hereby authorizes and ratifies its authorization of the use of the competitive contracting process for the Newark’s Mayor’s Office of Employment & Training Newark WORKS.
4. There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.
5. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
6. The Purchasing Agent shall file a duly executed copy of the contract in the Office of the City Clerk.
7. If required by State law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

This Resolution authorizes the Mayor and/or his designees, the Business Administrator and/or the Purchasing Agent, to enter into a contract with Newark WORKS, 375 McCarter Highway, 3rd Floor, Newark, New Jersey 07114, to serve as a Newark One Stop Career Center Operator for an amount not to exceed Two Hundred Forty Thousand Dollars and Zero Cents ($240,000.00) for a period not to exceed twenty-four (24) consecutive months, with two (2) one-year options to renew.
