WHEREAS, at the request of the Department of Engineering and review of the traffic operations by New Jersey Transit in conjunction with the City of Newark, Division of Traffic and Signals and pursuant to N.J.S.A 39:4-8(e), the following described locations are eliminated as bus stops:
1. In the North Ward, along Mount Prospect Avenue, southbound on the westerly side thereof:
Montclair Avenue, Near Side
Beginning at the northerly curb line of Montclair Avenue and extending 105ft northerly therefrom.
2. In the North Ward, along Mount Prospect Avenue, northbound on the easterly side thereof:
Montclair Avenue, Far Side
Beginning at the northerly curb line of Montclair Avenue and extending 100ft northerly therefrom.
WHEREAS, pursuant to N.J.S.A 39:4-8(e), a municipality may by ordinance, resolution or regulation designate or delete a bus stop.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. In the North Ward, the following described locations be hereby eliminated as bus stops:
a. along Mount Prospect Avenue, southbound on the westerly side, at Montclair Avenue (Near Side) beginning at the northerly curb line of Montclair Avenue and extending 105ft northerly therefrom.
b. along Mount Prospect Avenue, northbound on the easterly side, at Montclair Avenue (Far Side) beginning at the northerly curb line of Montclair Avenue and extending 100ft northerly therefrom.
2. No Municipal funds need to be expended for this act.
3. No Amendment will be made to this resolution without the approval of the Municipal Council of the City of Newark.
4. Upon approval, the Engineering Department will forward a copy of this resolution to the City Clerk's Office to notify them of the Local Government's approval for the deletion of bus stops as stated.
5. Upon approval, a certified copy of this resolution shall be forwarded to New Jersey Transit to notify them of the Local Government's approval for the deletion of bus stops as stated.
6. Pursuant to NJSA 39:4-8 (e), the proposed bus stop deletions do not require New Jersey Department of Transportation's approval.
STATEMENT
This resolution eliminates the following bus stops in the North Ward:
1. along Mount Prospect Avenue, southbound on the westerly side, at Montclair Avenue (Near Side) beginning at the northerly curb line of Montclair Avenue and extending 105ft northerly therefrom.
2. along Mount Prospect Avenue, northbound on the easterly side, at Montclair Avenue (Far Side) beginning at the northerly curb line of Montclair Avenue and extending 100ft northerly therefrom.
