WHEREAS, the City of Newark, 920 Broad Street, Newark, New Jersey, 07102 (the “City”) owns property located at Paterson Hamburg Turnpike at Canistear Road, Stockholm, New Jersey, designated as Block 566.02, Lot 1; and
WHEREAS, the New Jersey Department of Transportation (“State” or “NJDOT”) intends to reconstruct and improve the Route 23 Northbound Bridge over Pequannock River located in Stockholm, Passaic County (hereinafter called the “Project”); and
WHEREAS, in the attached NJDOT documents the State identified and refers to the property as Route 23, Section 5, Parcel E84; and
WHEREAS, the Project requires a Temporary Construction Easement Agreement for a property located at Paterson Hamburg Turnpike at Canistear Road, Stockholm, New Jersey, which is owned by the City; and
WHEREAS, the State will reimburse the City the amount of One Thousand Seven Hundred Dollars and Zero Cents ($1,700.00) for use of the identified property; and
WHEREAS, the State and City desire to enter into and execute a Temporary Construction Easement Agreement for access to the City property described in the Schedule A and depicted in the Exhibit B Map (hereto attached).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized on behalf of the City of Newark to enter into a Temporary Construction Easement Agreement and such other necessary documents that may be required with the New Jersey Department of Transportation (NJDOT) for the Route 23 Northbound Bridge over Pequannock River project, and a property located at Paterson Hamburg Turnpike at Canistear Road, Stockholm, New Jersey, Block 566.02, Lot 1, for a reimbursement amount of One Thousand Seven Hundred Dollars and Zero Cents ($1,700.00), for a construction easement period of twelve (12) months from date of Notice from the State’s Resident Engineer.
2. The Director of Water and Sewer Utilities shall file a fully executed copy of this Agreement in the Office of the City Clerk.
3. No changes shall be made to the terms and conditions of this Agreement without prior Municipal Council approval.
4. No municipal funds are required or will be spent under this Agreement or for this State Project.
STATEMENT
The Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to enter into a Temporary Construction Easement Agreement with the New Jersey Department of Transportation (NJDOT), in relation to the Route 23 Northbound Bridge over Pequannock River Project for a property located at Paterson Hamburg Turnpike at Canistear Road, Stockholm, New Jersey, Block 566.02, Lot 1, for a reimbursement amount of $1,700.00, for a contract period of twelve (12) months from date of Notice from the State’s Resident Engineer.
