WHEREAS, on or about July 25, 2016, on behalf of the City of Newark (the “City”), the Newark Community Economic Development Corporation (“NCEDC”), the then designee of the Mayor of the City of Newark, submitted an application (“Application”) to the New Jersey Department of Environmental Protection, Office of Natural Resource Restoration (“NJDEP ONRR”) in solicitation of its Passaic River Natural Resource Restoration: the Newark Bay Complex Grant requesting grant funding, in the amount of Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00), to develop public access on the Passaic River and Newark Bay Complex (“Riverfront Park Expansion Project”); and
WHEREAS, as a result of this Application, the City was awarded a grant in the amount of Seventeen Million Nine Hundred Sixty-Two Thousand Dollars and Zero Cents ($17,962,000.00) from the NJDEP ONRR to develop public access on the Passaic River and Newark Bay Complex, (primarily for the purchase of land that is located along the Passaic River and Newark Bay Complex); and
WHEREAS, the Riverfront Park Expansion Project has been divided into five development phases, specifically, Phases A, B, C, D & E; and
WHEREAS, the City still desires to further the public interest by obtaining a grant from NJDEP ONRR in the amount of approximately Seven Million Eighteen Thousand One Hundred Eighty Four Dollars and Thirty Cents ($7,018,184.30) for Phase C of the Riverfront Park Expansion Project; and
WHEREAS, the NJDEP ONRR has approved a grant of up to Seven Million Eighteen Thousand One Hundred Eighty Four Dollars and Thirty Cents ($7,018,184.30) for Phase C of the Riverfront Park Expansion Project; and
WHEREAS, the City finds it in the best interest of the City of Newark to accept the grant in the amount of Seven Million Eighteen Thousand One Hundred Eighty Four Dollars and Thirty Cents ($7,018,184.30) from the NJ DEP ONRR for Phase C of the Riverfront Expansion; and to enter into a grant agreement with NJDEP ONRR (“Grant Agreement”) in order to receive the grant award,
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council hereby ratifies its authorization of the Application from the date of application submission to the date of adoption of this authorizing Resolution.
2. The Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to submit an application and/or request to the New Jersey Department of Environmental Protection, Office of Natural Resource Restoration in solicitation of its Passaic River Natural Resource Restoration: Newark Bay Complex Grant requesting grant funding in the amount of Seven Million Eighteen Thousand One Hundred Eighty Four Dollars and Thirty Cents ($7,018,184.30) for Phase C of the Riverfront Park Expansion Project.
3. The Municipal Council hereby authorizes the Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute, on behalf of the City of Newark, the Grant Agreement with NJDEP ONRR in order to accept and receive the grant award in the amount of Seven Million Eighteen Thousand One Hundred Eighty Four Dollars and Thirty Cents ($7,018,184.30) for Phase C of the of the Riverfront Park Expansion Project.
4. The Municipal Council does hereby authorize and agree to match fifty percent (50%) of the total project amount, in compliance with the match requirements of the Grant Agreement.
5. The City of Newark agrees to comply with all applicable Federal, State, and municipal laws, rules and regulations in its performance pursuant to the Grant Agreement.
6. The Municipal Clerk shall provide a certified copy of this Resolution to NJDEP ONRR.
7. The agreement between the City and NJDEP ONRR is hereby ratified from March 22, 2017, to the date of adoption of this authorizing Resolution.
8. The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a fully executed copy of the Grant Agreement together with this Resolution and any accompanying documents.
STATEMENT
This Resolution ratifies and authorizes the actions taken by the Deputy Mayor/Director of the Department of Economic Housing and Development and/or the NCEDC designee to submit an application and/or request for the Newark Bay Complex Grant funding from New Jersey Department of Environmental Protection, Office of Natural Resource Restoration (“NJDEP ONRR”) to purchase land and develop public access on the Passaic River, and Newark Bay Complex, and furthermore, authorizes the Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economics and Housing Development to enter into and enter into and execute a Grant Agreement with NJDEP ONRR to accept and receive grant funds in the amount of Seven Million Eighteen Thousand One Hundred Eighty Four Dollars and Thirty Cents ($7,018,184.30) from NJDEP ONRR for Phase C of the Riverfront Expansion Project, which will be matched by the City in compliance with the match requirements of the Grant Agreement.
