 WHEREAS, on January 1, 2016 through March 31, 2016, an emergency contract was entered into for employee health benefits to allow for the continued operation of medical benefits; and                

 

WHEREAS, it is imperative that the City continue to maintain employee medical benefits; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-6, the extension of the emergency contract is needed for the health, safety, and welfare of the employees, retirees, and eligible dependents; and

 

WHEREAS, pursuant to N.J.A.C. 5:34-6.1, the City is in need of an extension of the existing emergency contract, in order to maintain the level of healthcare coverage; and

 

WHEREAS, on August 1, 2012, the Newark Municipal Council adopted the Contractor Pay-to Play Reform Ordinance, 2:4-22C, which forbids, inter alia, the award of a contract to a Business Entity, as defined therein, which has made or solicited  political contributions to (i) a candidate, candidate committee or joint candidate committee of any candidate for elective municipal office in the City of Newark or a holder of public office having ultimate responsibility for the award of a contract, or (ii) to any City if Newark or County of Essex political committee or political party committee, or (iii) to any continuing political committee or political action committee that regularly engages in the support of City of Newark municipal or County of Essex elections and/or City of Newark municipal or County of Essex candidates, candidates committees, joint candidate committees, political committees, political parties, political party committees, (hereinafter “PAC’), in excess of the thresholds specified in subsection (g) within one (1) calendar year immediately preceding the date of the contract or agreement; and

 

WHEREAS, the Business Entity and/or any of its subcontractors, if any, have certified that it is in compliance with the aforementioned Contractor Pay-to-Play Reform Ordinance 2:4-22C; and

 

WHEREAS, City Ordinance 6PSF-e, April 6, 2011, Article 2:5-13.2(E)(1) (b), (c), states that Emergency Contracts shall not be for a period in excess of ninety (90) days; and no extensions of an emergency contracts shall be permitted without authorization by resolution by the Municipal Council. 

           

            NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.  The Mayor and/or his designee, the Business Administrator and the Personnel Director, are hereby authorized to extend the emergency contract with Horizon Blue Cross Blue Shield of New Jersey, Three Penn Plaza East, Newark, New Jersey 07105 and Aetna, 1425 Union Meeting Road, P.O. Box 1445, Blue Bell, Pennsylvania 19422, and Magellan Health Services, 14100 Magellan Plaza Drive, Maryland Heights, Missouri 63043, Aetna, 1425 Union Meeting Road, P.O. Box 1445, Blue Bell, Pennsylvania 19422, and O.C.A, Benefit Services, LLC, 3705 Quakerbridge Road, Suite 216, Mercerville, New Jersey 08610 and Prudential Life Insurance, 80 Livingston Avenue, Roseland, New Jersey 07068 and MedPro Wellness LLC, 201 Dey Street, Unit 108, Harrison, New Jersey 07029 and Group Dental Health Administrators, Inc., 66 Route 17 North, Paramus, New Jersey 07652 and Brown & Brown, 56 Livingston Avenue, Roseland, New Jersey 07068, for the provision of employee health benefits services. 

 

2.        This extension will allow the continuation of Emergency Contract IG #16-13 that commenced on January 1, 2016 through March 31, 2016, we are requesting an extension until December 31, 2016, or until the actual and imminent emergency condition is abated in the City of Newark.

 

3.        An executed copy of said emergency contract extension shall be filed with the Office of the City Clerk by the Business Administrator for the City of Newark.

 

4.       The total amount of said emergency including the amount expended to date shall not exceed the $110,000,000.00 budgeted for the year.

 

STATEMENT

 

This resolution ratifies and authorizes the Mayor and/or his designees, the  Business Administrator and the Personnel Director, to extend Emergency Contract IG #16-13,  with Horizon Blue Cross Blue Shield of New Jersey, Three Penn Plaza East, Newark, New Jersey 07105 and Aetna, 1425 Union Meeting Road, P.O. Box 1445, Blue Bell, Pennsylvania 19422, and Magellan Health Services, 14100 Magellan Plaza Drive, Maryland Heights, Missouri 63043, Aetna, 1425 Union Meeting Road, P.O. Box 1445, Blue Bell, Pennsylvania 19422, and O.C.A, Benefit Services, LLC, 3705 Quakerbridge Road, Suite 216, Mercerville, New Jersey 08610 and Prudential Life Insurance, 80 Livingston Avenue, Roseland, New Jersey 07068 and MedPro Wellness LLC, 201 Dey Street, Unit 108, Harrison, New Jersey 07029 and Group Dental Health Administrators, Inc., 66 Route 17 North, Paramus, New Jersey 07652 and Brown & Brown, 56 Livingston Avenue, Roseland, New Jersey 07068, for the provision of employee health benefits, for the period from January 1, 2016 through December 31, 2016, or until such earlier time as the emergency condition is abated. Total amount to be expended shall not exceed $110,000,000.00 for the year.
