WHEREAS, on June 9, 2015, the City of Newark through its Purchasing Director, advertised to solicit bids for Rental of Parking Spaces in a Lot or a Garage which the contractor will provide to the City of Newark, for the Office of the City Clerk, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing distributed four (4) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on June 25, 2015, the Division of Central Purchasing received three (3) bids in response to this advertisement; and
WHEREAS, the Office of the City Clerk contested the award of the contract to SP Plus Corporation because of prior negative performance and experience; and
WHEREAS, the City Clerk notified SP Plus Corporation of its disqualification, and advised the company that it could request a hearing. The vendor did not respond to the notification. Before the conclusion of the disqualification process SP Plus Corporation informed Central Purchasing that it had changed circumstances since the bid and that it no longer owned the property of interest to lease; and
WHEREAS, the Supervising Procurement Specialist subsequently reviewed the bid of the second lowest responsive and responsible bidder and recommends an award to J & L Parking Corporation; and
WHEREAS, pursuant to N.J.S.A.40A:11-24 the vendor agreed to hold the prices bid until such time as an award is made; and
WHEREAS, pursuant to N.J.S.A.19:44A-20.5 et seq., solicitations through public bidding meets the requirements of the fair and open process.
NOW, THEREFORE BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
1. The Mayor and /or his designee, the Supervising Procurement Specialist, are authorized to enter into a contract with J & L Parking Corporation, 9 Kensington Place, Roseland, New Jersey 07068, to provide the Rental of Parking Spaces in a Lot or a Garage, to the City, whose bid was received on the advertised due date and determined to be the next responsive and responsible bidder, in accordance with bid specifications. The contract term will be established for one (1) year, pursuant to N.J.S.A. 40A:11-3.
2. There shall be no amendment or change of this contract without the approval of the Municipal Council.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2016 and subsequent years are contingent upon appropriations; pursuant to N.J.A.C. 5:30-5.5.
4. This is an open-ended contract to be used as needed during the term of the contract. Thus for any and all expenditures, against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b) shall be required each time an order is placed, from Fund NW011- 020- 0201- 7161- B2016, covering the amount of the service. This contract shall not exceed $33,600.00 for a one (1) year term.
5. The Supervising Procurement Specialist shall file a fully executed copy of this contract in the Office of the City Clerk.
6. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
Resolution authorizing the Mayor and /or his designee, the Supervising Procurement Specialist, to enter into a contract with J&L Parking Corporation, to provide Rental of Parking Spaces in a Lot or a Garage to the City of Newark, at a cost not to exceed $33,600.00 for a term or one (1) year.
