This Resolution will amend the 2022 NJDEP Volkswagen Mitigation Grant Project, Equipment Modernization Program award allocation amount to read $4,851,375.22 from $1,065,108.00, and increasing the number of electric chassis refuse trucks to be funded from two (2) to a total of eight (8), with a City contribution of $537,854.66 for the Project.
The City of Newark will provide a cash match contribution in the amount of $537,854.66 in the 2024 Operating Budget under Special Appropriation Line Item 011 230 2301.

WHEREAS, N.J.S.A. 40A:4-87 provides that the Director of the Division Local Government Services may approve the insertion of any Special Item of Revenue in the budget of any local unit when such item shall have been made available by law and the amount thereof shall not have been determined at the time of the adoption of the budget, and may approve the insertion of an appropriation item of equal amount for the purpose of carrying out the purposes of the law making such item of revenue available for expenditure; and
WHEREAS, the State of New Jersey, Department of Environmental Protection (“NJDEP”), Volkswagen Mitigation Grant Project, managed by the Equipment Modernization Program has made available funds in the amount of Four Million Eight Hundred and Fifty-One Thousand Three Hundred Seventy-Five Dollars and Twenty-Two Cents ($4,851,375.22),for electrification projects, including the replacement of heavy-duty vehicles/engines such as buses, trucks, and non-road equipment in urban areas disproportionately impacted by diesel emissions, as well as electric vehicle charging/fueling infrastructure installation in strategic locations across the state; and
WHEREAS, by an award letter dated August 3, 2022 from the State of New Jersey, Department of Environmental Protection (“NJDEP”), the City was awarded a grant in the amount of Four Million Eight Hundred and Fifty-One Thousand Three Hundred Seventy-Five Dollars and Twenty-Two Cents ($4,851,375.22), to purchase eight (8) electric chassis refuse trucks, for the benefit of the City of the Newark.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. In accordance with the provisions of N.J.S.A 40A: 4-87, the City of Newark, New Jersey hereby requests the Director of Local Government Services to approve a budget insertion in the amount of Four Million Eight Hundred and Fifty-One Thousand Three Hundred Seventy-Five Dollars and Twenty-Two Cents ($4,851,375.22), and an appropriation of an equal amount for the FY 2023 Volkswagen Mitigation Grant Project, Equipment Modernization Program in the budget year 2023 as set forth in Schedule A, attached hereto and made a part hereof.
2. The aforesaid insertion is, in the opinion of the Governing Body, warranted and authorized by N.J.S.A. 40A:4-87 and are necessary for the orderly operation of the municipality.
3. A copy of this Resolution shall be filed with the Director of the Division of Local Government Services by the City Clerk.
STATEMENT
This Resolution is establishing an appropriation and revenue in the FY 2023 Municipal Budget in the amount of Four Million Eight Hundred and Fifty-One Thousand Three Hundred Seventy-Five Dollars and Twenty-Two Cents ($4,851,375.22), for the FY 2023 Volkswagen Mitigation Grant Project, Equipment Modernization Program. The New Jersey, Department of Environmental Protection (“NJDEP”), Volkswagen Mitigation Grant Project, managed by the Equipment Modernization Program, is providing these funds The City of Newark will provide a cash match contribution in the amount of $537,854.66 in the 2024 Operating Budget under Special Appropriation Line Item 011 230 2301. The project period is June 13, 2022 through June 13, 2025 (City-wide).
