WHEREAS, on February 5, 2025 the City of Newark (the "City"), through its Purchasing Agent, QPA, advertised solicitation of bids for contractors to provide Rental of Chairs, Tables Folding Wood and Metal, and Tent Heaters for Municipal Council and the Office of the City Clerk, Departments of Public Safety, Recreation, Cultural Affairs and Senior Services, Health and Community Wellness/Divisions of Medical Care Services and Childhood Lead and Department of Public Works.

 

WHEREAS, the Division of Central Purchasing published the bid package on the City of Newark's electronic procurement website to provide broader access and download capability to potential bidders; and

 

WHEREAS, on February 20, 2025 the Division of Central Purchasing received Three (3) bids in response to this advertisement; and

 

WHEREAS, Municipal Council and the Office of the City Clerk, Department of Public Safety/Police, Department of Recreation, Cultural Affairs and Senior Services, Department of Health and Community Wellness/Divisions Medical Care Services and Childhood Lead, and the Department of Public Works recommended that a multiple award be made to the following bidders, being the lowest responsive and responsible, per commodity line item, per year:

 

1.                     All Star Rentals, Inc., 61 Willet Street Suite 7, Passaic, New Jersey 07055;

2.                     Random Access Entertainment, 753 Summer Avenue, Suite 2C, Newark, New Jersey 07104;

3.                     Cabaret Rentals, Inc., 2704 Arthur Kill Road, Staten Island, New York 10309

 

WHEREAS, the Purchasing Agent, QPA, concurs with the recommendations from the various City’s offices listed above;

 

WHEREAS, pursuant to N.J.S.A. 40A:11-24, the recommended bidders consented to holding their bids for consideration until such time as an award is made, as the law permits; and

 

WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirements of the Fair and Open Process.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into, and execute contract(s) with 1.) All Star Rentals, Inc., 61 Willet Street Suite 7, Passaic, NJ 07055; 2.) Random Access Entertainment, 753 Summer Avenue, Suite 2C, Newark, New Jersey 07104; and 3.) Cabaret Rentals, Inc., 2704 Arthur Kill Road, Staten Island, NY 10309, to provide Rentals of Chairs, Tables Folding Wood and Metal and Tent Heaters.

 

2.                     Bids were received on the advertised due date and bidders were determined to be the lowest responsive and responsible, per line item commodity per year, in accordance with the bid specifications. Pursuant to N.J.S.A. 40A:11-15 the term of the contract will be established for a period not to exceed twenty-four (24) consecutive months, which shall commence on the date the contract is executed at a total cost not to exceed $269,000.00.

 

3.                     There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.

 

4.                     There shall be no advance payment on this contract, in accordance with N.J.S.A. 40A:5-16. Funds for subsequent years are contingent upon available appropriations, pursuant to N.J.A.C. 5:30-5.5(d)(2).

 

5.                     This is an open-ended contract to be used as needed during its term. For any expenditures against it, a certification of the availability of funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed.

 

6.                     The Purchasing Agent, QPA, shall file a copy of this resolution and the duly executed copy of the contract in the Office of the City Clerk.

 

7.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

STATEMENT

 

This resolution authorizes the Mayor and/or his designee, the Business Administrator or the Purchasing Agent to enter into and execute contract(s) with All Star Rentals, Inc., 61 Willet Street, Suite 7, Passaic, New Jersey 07055, Random Access Entertainment, 753 Summer Avenue, Suite 2C, Newark, NJ 07104 and Cabaret Rentals, Inc., 2704 Arthur Kill Road. Staten Island, New York 10309 for Rental of Chairs, Tables Folding Wood and Metal, and Tent Heaters for various municipal offices. The contract is for an amount not to exceed Two Hundred Sixty-Nine Thousand Dollars and Zero Cents ($269,000), and shall commence upon execution not to exceed twenty-four (24) consecutive months.
