Ordinance 6PSF-a(S) February 27, 2018 adopting the Second Amendment to Newark’s River: Public Access and Redevelopment Plan.

WHEREAS, on June 15, 2005, the Municipal Council of the City of Newark adopted Resolution 7Rdo(AS) designating the entire City of Newark as an area in need of rehabilitation; and

 

WHEREAS, on August 7, 2013, the Municipal Council of the City of Newark adopted Ordinance 6PSF-i adopting the Newark’s River: Public Access and Redevelopment Plan (the “Original Plan”); and

 

WHEREAS, on October 11, 2017, the Municipal Council of the City of Newark adopted Ordinance 6PSF-a(S) adopting the First Amendment to Newark’s River: Public Access and Redevelopment Plan (“First Amended Plan”); and

 

WHEREAS, on February 27, 2018, the Municipal Council of the City of Newark adopted Ordinance 6PSF-a(S) adopting the Second Amendment to Newark’s River: Public Access and Redevelopment Plan (“Second Amended Plan”); and

 

WHEREAS, on April 3, 2019, the Municipal Council of the City of Newark adopted Ordinance 6PSF-a adopting the Third Amendment to Newark’s River: Public Access and Redevelopment Plan (“Third Amended Plan”); and

 

WHEREAS, the Department of Economic and Housing Development and the Newark Planning Office propose the following further changes to the Newark’s River: Public Access and Redevelopment Plan, as amended: Creation of a new plan district known as the “Mixed Use Ballantine Brewery District” within Blocks 2022, 2023, 2474, a portion of 2475, 2486, 2487, and 2495 bound by Fleming Avenue, Christie Street, Lexington Street and the Redevelopment Plan boundary, described below:

 

1)                     The Ballantine Brewery Mixed Use District (BMU) recognizes that the multi-block factory complex that comprised the former Ballantine Brewery is a significant feature in the eastern Ironbound neighborhood and is uniquely situated for comprehensive redevelopment.

 

2)                     The BMU comprises Blocks 2022, 2023, 2474, a portion of 2475, 2486, 2487, and 2495.

 

3)                     The maximum permitted height in the BMU is 8 stories. A 10’ step-back from Ferry Street-facing building façade is required beginning with the 5th story. Subsurface parking and other basement uses do not count as a story.

 

4)                     The permitted uses applicable to the Mixed Use 1 (Light Industrial, Residential, Retail) shall apply.

 

5)                     No minimum front yard setback is required. A maximum setback of 6 feet is permitted. If existing structures are to be adaptively reused, they are permitted to remain in the same position with respect to all setback and step-back requirements.

 

6)                     Parking standards for the Ballantine Brewery Mixed Use District shall be reduced from the plan standards. A minimum of 0.25 parking spaces per residential unit shall be required.

 

7)                     Parking garages shall be permitted at grade level along streets other than Ferry Street without retail storefronts.

 

8)                     Parking garages at grade level shall be screened or treated with artistic and/or architectural design features to make them attractive and reduce monolithic massing.

 

9)                     Active Street fronts per Section 8-P shall be required along Ferry Street. The setback may vary along Active Street fronts to accommodate a sidewalk with a minimum of 12 feet in width.

 

10)                     Revised plan pages showing the above changes and a map of the area in question are attached hereto as Exhibit A.

 

WHEREAS, the Municipal Council requests that the Central Planning Board consider a Fourth Amendment to the Newark’s River: Public Access and Redevelopment Plan and transmit its recommendations regarding consistency with the City Master Plan and other matters pursuant to N.J.S.A. 40A:12A-7(f). 

 

NOW, THEREFORE, BE IT RESOLVED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT: 

 

1.                     The Municipal Council hereby directs the Central Planning Board consider the following changes as to a Fourth Amendment to the Newark’s River: Public Access and Redevelopment Plan pursuant to N.J.S.A. 40A:12A-7(f):

 

a.                     The Ballantine Brewery Mixed Use District (BMU) recognizes that the multi-block factory complex that comprised the former Ballantine Brewery is a significant feature in the eastern Ironbound neighborhood and is uniquely situated for comprehensive redevelopment.

 

b.                     The BMU comprises Blocks 2022, 2023, 2474, a portion of 2475, 2486, 2487, and 2495.
