WHEREAS, pursuant to Resolution 7R12-b adopted on April 5, 2023, the Municipal Council ratified and authorized the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities ("the Department") to execute grant documents for a grant from the State of New Jersey, Department of Environmental Protection (Watershed and Land Management) in the amount of $286,400.00 to fund the project for Lake(s) - algal control treatment and Echo Lake Protection Plan; and
WHEREAS, the Resolution incorrectly set forth the grant period as a one-time grant coverage for the years 2023, 2024 and 2025; and
WHEREAS, the correct "work period" as set forth in the grant documents commences upon the date the State executes the grant agreement and runs for a period of 36 months thereafter; and
WHEREAS, the Director of the Department seeks to amend Resolution 7R12-b to correct the description of the work period to "commences upon the date the State executes the grant agreement and runs for a period of 36 months thereafter."
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R12-b adopted on April 5, 2023 is amended to correct the description of the work period commencing from "a one-time grant coverage for the years 2023, 2024 and 2025" to "commencing upon the date the State executes the grant agreement and runs for a period of 36 months thereafter."
2. All other authorizations set forth in Resolution 7R12-b adopted on April 5, 2023 remain the same.
3. The Director of the Department of Water and Sewer Utilities shall file a fully-executed copy of the Water Quality Restoration 2020-2022 agreement in the Office of City Clerk.
STATEMENT
This Resolution authorizes an amendment to Resolution 7R12-b adopted on April 5, 2023 to correct the description of the work period "commencing from a one-time grant coverage for the years 2023, 2024 and 2025" to "commencing upon the date the State executes the grant agreement and runs for a period of 36 months thereafter."
