WHEREAS, the Federal Highway Administration's (FHWA) Federal Aid Program administered by the State of New Jersey Department of Transportation ("NJDOT") for the 2016 Safe Routes to School Program (SRTS), provides grant funding for improvements that enable and encourage walking and bicycling to school; and

WHEREAS, the City of Newark needs to improve various streets and sidewalks at various schools throughout the City; and

WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the 2016 Safe Routes to School Program (SRTS) to improve various streets and sidewalks at various schools throughout the City of Newark; and

WHEREAS, on May 31, 2016, on behalf of the City of Newark, the Director of the Department of Engineering, submitted an application to NJDOT requesting grant funding in the amount of $1,200,000.00 from the 2016 Safe Routes to School Program (SRTS), identified as application SRS-2016-2016 Building Safe Routes to School - 00022, to improve various streets and sidewalks at several schools throughout the City of Newark, with no City funds required; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, SRS-2016-2016 Building Safe Routes to School - 00022, the Director of Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Municipal Council of the City of Newark formally approves the grant application for the above-stated project.

2. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application identified as SRS-2016-2016 Building Safe Routes to School - 00022 to the New Jersey Department of Transportation ("NJDOT") on behalf of the City of Newark, requesting grant funding in the amount of $1,200,000.00 from the 2016 Safe Routes to School Program (SRTS), to improve various streets and sidewalks at various schools throughout the City of Newark, with no City funds required (a copy of the application is attached hereto and made a part hereof).

3. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.

4. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.

5. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the NJDEP to receive and expend the grant award to improve various streets and sidewalks at various schools throughout the City of Newark.

6. Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the Corporation Counsel and the Business Administrator for review, approval, and signature.

7. No municipal funds are required for receipt or acceptance of this grant award.

8. The Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.

This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to submit an electronic grant application identified as SRS-2016-2016 Building Safe Routes to School - 00022, in the amount of $1,200,000.00 from the 2016 Safe Routes to School Program (SRTS), to improve various streets and sidewalks at various schools throughout the City of Newark, with no City funds required.
