WHEREAS, on January 26, 2017, the City of Newark’s Department of Public Safety, Police Division (“NPD”), submitted a grant application to the U.S. Department of Justice, Bureau of Justice Assistance (“DOJ”), for the “FY 17 SMART Policing Initiative”; and
WHEREAS, as part of the proposal, the NPD indicated in the grant application that it would be partnering with Rutgers University (“Rutgers”), whereby Rutgers would be providing planning, research, and evaluation services to NPD should the grant be awarded to the NPD; and
WHEREAS, on October 19, 2017, the DOJ awarded the NPD a $700,000.00 three-year grant under the “FY 17 SMART Policing Initiative; and
WHEREAS, on February 7, 2018, the Newark Municipal Council, by way of Resolution 7R9-a, ratified and authorized the Mayor and/or his designee to [i] submit the grant application, [ii] accept the grant funds and [iii] execute and enter into the Grant Award and Special Conditions documents necessary to receive the grant funds; and
WHEREAS, as a condition of the award, the NPD must enter into a sub-contract with Rutgers, whereby Rutgers would provide to NPD planning, research and evaluation services associated with the grant; and
WHEREAS, the NPD wishes to engage Rutgers to perform the services described herein for the purposes of planning, research and evaluation services for the grant; and
WHEREAS, Rutgers, an instrumentality of the State of New Jersey, has the ability and resources to provide such services as outlined in the above-mentioned City grant application; and
WHEREAS, the City and Rutgers wish to enter into a contract for the provision of planning, research and evaluative services relative to the City’s “FY 17 SMART Policing Initiative”; and
WHEREAS, this is a no-bid contract, awarded without competitive bidding, as an exception to the Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5(2), being that the contract is between the City and Rutgers, an instrumentality of the State of New Jersey; and
WHEREAS, because Rutgers is an instrumentality of the State of New Jersey and not a for-profit business entity, the provisions of the State Pay-to-Play legislation and the City’s Pay-to-Play Reform Ordinance, R.O. 2:4-22C, do not apply.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Public Safety Director, are hereby authorized to enter into and execute a contract with Rutgers University, 249 University Avenue, Newark, New Jersey 07102, for planning, research and evaluative services for the City’s ““FY 17 SMART Policing Initiative,” for the period commencing from the date this resolution is adopted through September 30, 2020 in an amount not to exceed $140,000.00.
2. This contract is awarded without competitive bidding as an exception to the Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5(2), in that the contract is between the City of Newark and Rutgers University, an instrumentality of the State of New Jersey, and furthermore is not subject to the State Pay-to-Play legislation or the City’s Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, because Rutgers University is an instrumentality of the State and not a for-profit business entity.
3. The funds certified from the Chief Financial Officer, in the amount of $140,000.00 shall be charged to: Business Unit 051 Dept. ID G18 Division/Project P18Q0 Account# 71280 Budget Ref: B2018. There are sufficient funds available for the purpose set forth hereinabove.
4. The Director of Public Safety shall file a fully executed copy of the contract in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Public Safety, to enter into and execute a contract with Rutgers University, 249 University Avenue, Newark, New Jersey 07102, for the provision of planning, research and evaluative services for the City’s “FY 17 SMART Policing Initiative,” for the period commencing on the date this resolution is adopted by the Municipal Council, through September 30, 2020, in an amount not to exceed $140,000.00.
