Whereas, the Non-Federal Cost Share Program under the Superstorm Sandy Community Development Block Grants-Disaster Recovery referred hereto as (CDBG-DR) mission under the United States Congress, through the Disaster Relief Appropriations Act of 2013, Public Law 113-2 appropriated funding to the United States Department of Housing and Urban Development referred hereto as (HUD) to be allocated as a CDBG-DR among entities, is to provide crucial funding for recovery efforts involving housing, economic development, infrastructure and prevention of further damage to affected areas impacted by Superstorm Sandy; and
Whereas, on behalf of the City of Newark, the Coordinator of the Division of The Office of Emergency Management and Homeland Security and Preparedness, under the Department of Public Safety, submitted an application to the State of New Jersey Department of Community Affairs, Sandy Recovery Division which submitted a complete application entitled “Action Plan” to the United States Department of Housing and Urban Development (HUD) wherein the damages and expenses sustained as a result of Superstorm Sandy were identified; and
Whereas, as a result of this application, the City of Newark has been awarded a grant in the amount of $398,681.00 from the State of New Jersey, Department of Community Affairs, Sandy Recovery Division, to provide funding to the City of Newark to cover the ten percent (10%) non-federal cost share for the FEMA Public Assistance Program for Category A (debris removal) and Category B (emergency protective measures) expenses incurred during Superstorm Sandy as approved by HUD commencing on November 16, 2016 and terminating on November 30, 2019 (a copy of the November 16, 2016, Award Letter from the State of New Jersey Department of Community Affairs Sandy Recovery Division is hereto attached and made a part hereof); and
Whereas, the City must execute a grant agreement with the State of New Jersey Department of Community Affairs Sandy Recovery Division in order to obtain the grant award with no additional municipal funds required (a copy of the grant agreement is attached hereto and made a part hereof).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Coordinator of the Division of the Office of Emergency Management and Homeland Security and Preparedness, under the Department of Public Safety, are hereby authorized to submit an application to the State of New Jersey Department of Community Affairs Sandy Recovery Division, and hereby, to request grant funding in the amount of $391,036.35. from the Community Development Block Grant- Disaster Recovery Program, to provide funding to the City of Newark to cover the ten percent (10%) non-Federal cost share for the FEMA Public Assistance Program for Category A (debris removal) and Category B (emergency protective measures) conducted during Superstorm Sandy.
2. The Municipal Council hereby ratifies its authorization of this application from the date of the application’s submission to the date of adoption of this authorizing resolution.
3. The grant award in the amount of $398,681.00 from the State of New Jersey Department of Community Affairs (DCA), is hereby accepted.
4. The Mayor and/or his designee, the Director of the Department of Public Safety, are hereby authorized to enter into and execute grant documents with the State of New Jersey Department of Community Affairs Sandy Recovery Division, to receive and expend the grant award in the amount of $398,681.00, for costs attributed to debris removal and emergency protective measures during Superstorm Sandy.
5. The agreement between the City of Newark and the State of New Jersey Department of Community Affairs is hereby ratified from the date of adoption of this authorizing resolution.
6. No additional municipal funds are required for receipt or acceptance of this grant award.
7. The Coordinator of the Division of the Office of Emergency Management and Homeland Security and Preparedness, under the Department of Public Safety, shall file a fully-executed copy of the Community Development Block Grant-Disaster Recovery application, the grant award letter and grant agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Public Safety, to enter into and execute grant documents necessary to accept and expend State of New Jersey, Department of Community Affairs, Sandy Recovery Division, funding in the amount of $398,681.00, to cover the ten percent (10%) non-Federal cost share for the FEMA Public Assistance Program for Category A (debris removal) and Category B (emergency protective measures) activities conducted during Superstorm Sandy.
