WHEREAS, a grant and loan fund was established, jointly administered by the New Jersey Department of Environmental Protection (“NJDEP”) and the New Jersey Economic Development Authority (“NJEDA”) known as the Hazardous Discharge Site Remediation Fund (“HDSRF”) codified as N.J.S.A. 58:10B-1 et seq., dedicated for the provision of financial assistance to municipal governmental entities, individuals, corporations, partnerships and other private business entities for the purpose of financing remediation activities for sites, at which there is, or is suspected of being a discharge of hazardous substances or hazardous wastes; and

 

WHEREAS, the City of Newark (the “City”) has applied for and has been awarded a grant in the amount of up to Six Thousand Four Hundred Fifty Dollars and Zero Cents ($6,450.00) from the Hazardous Discharge Site Remediation Fund Municipal Grant Program through the New Jersey Department of Environmental Protection and the New Jersey Economic Development Authority for Remedial Investigation (RI) of the former Orbis Site; and

 

                     WHEREAS, the City has determined that there has been, or it suspects that there has been, a discharge of hazardous substances or a hazardous waste on the Property; and

                     

WHEREAS, as a result of this application, the City has been awarded a grant in the amount of Six Thousand Four Hundred Fifty Dollars and Zero Cents ($6,450.00) from the NJDEP for the remediation investigation of the former Orbis Site, 41-45 McClellan Street, 47-63 McClellan Street and 980-990 Frelinghuysen Rear, as Block 3773, Lots, 15, 41, 43 and 53, on the Official Tax Map of the City of Newark, for the period commencing on February 28, 2022 and terminating on December 31, 2023.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing  Development, are hereby authorized to submit an application to New Jersey Department of Environmental Protection (“NJDEP”) requesting grant funding in the amount of Six Thousand Four Hundred Fifty Dollars and Zero Cents ($6,450.00) from the Hazardous Discharge Site Remediation Fund (“HDSRF”) for the remediation investigation of former Orbis Site, 41-45 McClellan Street, 47-63 McClellan Street and 980-990 Frelinghuysen Rear, (Block 3773, Lots, 15, 41, 43 and 53) with no matching funding required by the City.

 

2.                     The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

 

3.                     The grant award in the amount of Six Thousand Four Hundred Fifty Dollars and Zero Cents ($6,450.00) from NJDEP is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).

 

4.                     The Agreement between the City and HDSRF is hereby ratified from February 28, 2022 to the date of the adoption of this authorizing Resolution.

 

5.                     A processing fee in the amount of Five Hundred Dollars and Zero Cents ($500.00) is required by the City for receipt or acceptance of this grant award.

 

6.                     The above referenced grant is hereby accepted, and the Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to execute grant documents as an authorized representative thereunder, as the representative for the City of Newark.

 

7.                     A comprehensive plan exists specifically for the development or redevelopment of contaminated or potentially contaminated real property in the host municipality or that a realistic opportunity exists that the Project Site will be developed or redeveloped within a three-year period from the completion of the remediation.

 

8.                     The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a fully-executed copy of the HDSRF grant application, the grant award letter, the grant agreement, and a copy of the Certification of Funds for any required matching funds in the Office of City Clerk.

 

9.                     A certified copy of this Resolution be forwarded to the NJEDA.

 

 

STATEMENT

 

                     This Resolution ratifies and authorizes the actions taken by the Deputy Mayor/Director of the Department of Economic and Housing Development to submit an application for grant funding from the NJDEP for the remediation investigation of the of former Orbis Site, 41-45 McClellan Street, 47-63 McClellan Street and 980-990 Frelinghuysen Rear (Block 3773, Lots, 15, 41, 43 and 53) and furthermore, ratifies and authorizes Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing  Development, to enter into and execute an Agreement with and accept grant funds in the amount of $6,450.00 from the NJDEP for the remediation investigation of the of former Orbis Site commencing on February 28, 2022 and terminating on December 31, 2023. A $500.00 processing fee is required for receipt or acceptance of this grant award.  No matching funding is required by the City.
