WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, advertised for receipt of bids on March 13, 2018, for Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets; and
WHEREAS, prior to anyone picking up specifications or submitting any bids, on March 13, 2018, the Department of Engineering, Division of Traffic and Signals, issued Addendum #1 for Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets, to change the date for the acceptance of bids from March 26, 2018 to March 29, 2018; and
WHEREAS, on March 15, 2018, the Department of Engineering, Division of Traffic and Signals, hand delivered a copy of the Addendum #1 to Granada Construction Corporation, 147 Thomas Street, Newark, New Jersey 07114, who acknowledged receipt of same on March 15, 2018; and
WHEREAS, in compliance with N.J.S.A. 40A:11-23 (c), on March 15, 2018, Juan Feijoo from the Department of Engineering, Division of Traffic and Signals, the principal engineer for Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets, executed a certification of personal service of Addendum #1 to Granada Construction Corporation, 147 Thomas Street, Newark, New Jersey 07114; and
WHEREAS, on March 29, 2018, one (1) bid was received for Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering desires to accept the bid proposal submitted by the lowest responsible bidder, Granada Construction Corporation, 147 Thomas Street, Newark, New Jersey 07114, and execute Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets, for the total bid amount of $542,300.00; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitation through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meets the requirement of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, Granada Construction Corporation, 147 Thomas Street, Newark, New Jersey 07114, and execute Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets, for the total bid amount of $542,300.00.
2. Attached hereto is a Certification of Funds issued by the Director of Finance which states that there are available sufficient legally appropriated funds in the amount of $542,300.00 for the purpose set forth hereinabove. Copies of the Certification of Funds issued shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
3. No changes to this contract are allowed without prior Municipal Council approval.
4. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A: 5-16.
5. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
6. This contract is to be completed within a period of 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
7. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
8. Funds for this contract in the amount of $542,300.00 is provided as below:
$476,539.00 from Fund 045, Dept. 17G, Division/Project 17A29, Account # 94710, Budget Year B2017.
$65,761.00 from Fund 011, Dept. 110, Division/Project 1107, Account# 71930, Budget Year B2018.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the bid proposal submitted by the lowest responsible bidder, Granada Construction Corporation, 147 Thomas Street, Newark, New Jersey 07114, and execute Contract No. 2017-05, All Wards Traffic Calming Program on Various Streets, for the total bid amount of $542,300.00.
This contract is to be completed within a period of 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
