WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) FY 2023 Bikeways State Aid Program provides municipalities with grant funding for bicycle lane projects; and
WHEREAS, on July 1, 2022, the Director of the Department of Engineering, on behalf of the City of Newark (“City”), submitted an application to NJDOT requesting grant funding from the Bikeway State Aid Program for the Newark Downtown Connector within the City of Newark, which was identified as application, BIKE-2023 Newark Downtown Connector for City of Newark, with no City funds required; and
WHEREAS, on August 3, 2022, the Municipal Council adopted Resolution 7R3-a ratifying and authorizing the Director of the Department of Engineering to apply for, accept, and enter into grant documents for a grant award for the Newark Downtown Connector; and
WHEREAS, on December 12, 2022, NJDOT announced that the City was selected to receive a grant award in the amount of Three Hundred Seventy-Nine Thousand Dollars and Zero Cents ($379,000.00) for the construction of Bikeway Program for the Newark Downtown Connector (“Project”); and
WHEREAS, NJDOT requires the City to award the contract for construction of the Project within two (2) years of the announcement of the receipt of a grant award, with a deadline of December 11, 2024; and
WHEREAS, in July 2024, the City requested from NJDOT and received an initial extension of the deadline from December 11, 2024 to June 12, 2025
WHEREAS, on September 05, 2024, the Municipal Council retroactively adopted Resolution 7R3-b ratifying the extension request from the NJDOT from December 11, 2024 through June 12, 2025; and
WHEREAS, a further extension is required, as the current timeline is insufficient to complete the award process; and
WHEREAS, the City wishes to request that the NJDOT extend the deadline an additional six months from June 12, 2025 to December 12, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to request a second extension from the New Jersey Department of Transportation (“NJDOT”) to allow the City of Newark additional time to award a contract for construction of the Bikeway Program for the Newark Downtown Connector (Project”). The second extension would extend the time to award said contract an additional six months from June 12, 2025 to December 12, 2025.
2. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to execute any document or agreement necessary to effectuate such extension.
3. All other terms and conditions of the grant award from the NJDOT for Bikeway State Aid Program for Newark Downtown Connector project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to request an second extension from NJDOT to allow the City of Newark more time to award a contract for construction of Bikeway Program for Newark Downtown Connector by December 12, 2025. No municipal funds are required.
