WHEREAS, professional appraisal services constitute professional services and are exempt from public bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., specifically N.J.S.A. 40A:11-5(1)(a)(i); and
WHEREAS, the Municipal Council, by Resolution 7R6-d (25-1571), adopted on December 17, 2025, authorized a contract with Hendricks Appraisal Company, LLC, 7 Hutton Avenue, West Orange, New Jersey 07052, to provide tax appraisal services concerning tax appeal matters, in an amount not to exceed One Hundred Fifty-Six Thousand Dollars and Zero Cents ($156,000.00), for the period January 1, 2026 through December 31, 2026; and
WHEREAS, the contract was awarded pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., specifically N.J.S.A. 40A:11-5(1)(a)(i) as a professional services contract, and in accordance with the fair and open process of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5; and
WHEREAS, the parties desire to amend the contract to reflect the change in the estimated compensation amount; and
WHEREAS, the Municipal Council finds that it is in the best interest of the City of Newark to amend the contract to increase the not-to-exceed amount and to update the funding source.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of Finance, are hereby authorized to enter into and execute a First Amendment to the contract with Hendricks Appraisal Company, LLC (“First Amendment”), to provide tax appraisal services concerning tax appeal matters, which will increase the original not-to-exceed contract amount from One Hundred Fifty-Six Thousand Dollars and Zero Cents ($156,000.00) to an amount not to exceed One Hundred Eighty Thousand Dollars and Zero Cents ($180,000.00), for the period January 1, 2026 through December 31, 2026.
2. The new funding source for this contract shall be: Finance Department - Fund NW045, Department 18G, Div./Proj. 18B00, Account 94710, Ref: B2018. Resolution 7R6-d December 17, 2025 (25-1571) is hereby amended to reflect that the funding source stated therein has been replaced by the new funding source. Attached hereto is the certification of the Director of Finance indicating that funds in the amount of $180,000.00 are available from the new funding source (i.e., Budget Account # NW045-18G-18B00-94710 B2018).
3. All other terms and conditions of Resolution 7R6-d December 17, 2025 (25-1571) and the underlying Agreement shall remain unchanged and in full force and effect.
4. Any and all actions previously taken by the Director of Finance, the Tax Assessor, and/or any other authorized City officials in connection with the subject matter of this Resolution, including but not limited to services performed by Hendricks Appraisal Company, LLC in reliance upon the intended compensation amount, are hereby ratified and confirmed to the extent permitted by law.
5. The Director of Finance shall file a copy of the fully executed First Amendment together with the executed Agreement in the Office of the City Clerk, and the same shall be made available for public inspection.
6. A notice of this action shall be published in the newspaper authorized to publish legal advertisements within ten (10) days of the adoption of this resolution, as required by law.
7. There shall be no advance payments on this contract.
8. This Resolution shall take effect immediately upon adoption.
STATEMENT
This Resolution authorizes and amends Resolution 7R6-d December 17, 2025 (25-1571) to increase the contract amount with Hendricks Appraisal Company, LLC from $156,000.00 to $180,000.00 and to update the funding source for tax appraisal services concerning tax appeal matters, while ratifying prior actions taken in connection with the contract.
