WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of Three hundred Ninety-Five Thousand Eight Hundred Seventy-Nine Dollars and Zero Cents ($395,879.00), for the Edward Byrne Memorial Justice Assistance Grant (JAG) Program and no adequate provision has been made in the 2025 Temporary Budget for the aforesaid purpose; and
WHEREAS and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, pursuant to Resolution 7R9-d, adopted on May 21, 2025, from the United States Department of Justice, Bureau of Justice Assistance awarded the City of Newark Three hundred Ninety-Five Thousand Eight Hundred Seventy-Nine Dollars and Zero Cents ($395,879.00) (“Grant Award”) to fund overtime cost to address violent crime, and will distributed among several agencies within Essex County; and
WHEREAS, pursuant to the Grant Award, the City entered into a Memorandum of Understanding with participating agencies, represented by their respective law enforcement Executive, to allocat the Grant Award pursuant to the following schedule:
Newark = $265,395.00
Irvington = $45,068.00
East Orange = $45,151.00
Orange = $27,609.00
Essex County Sheriff = $12,656.00; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriation adopted in 2025 pursuant to N.J.S.A. 40A:4-20 including this resolution total…………………$428,064,443.59.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. A temporary emergency appropriation be and the same is hereby made for the following classification.

2. Said emergency appropriation shall be provided for in the 2025 budget.
3. A copy of this Resolution shall be filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This Resolution establishes the temporary emergency appropriation for funding for overtime to address violent crime in the amount of Three hundred Ninety-Five Thousand Eight Hundred Seventy-Nine Dollars and Zero Cents ($395,879.00). The United States Department of Justice, Bureau of Justice Assistance awarded the funds. The project period is October 1, 2020 through September 30, 2025.
