This Amending Resolution will extend the term of the contract by six (6) additional month, from November 11, 2025 through May 11, 2026 for the completion of the project, at no additional cost to the City of Newark.

WHEREAS, Resolution 7R3-a, adopted on March 1, 2023, authorized the Acting Director of the Department of Engineering to accept the proposal dated June 10, 2021 submitted by Michael Baker, International, Inc., One Gateway Center, Suite 2330, Newark, New Jersey 07102, and execute Contract #2021-02PS, for the Newark Riverfront Pedestrian and Bicycle Access, Concept Development Study Project, in the amount not to exceed Four Hundred Ninety-Eight Thousand Dollars and Zero Cents ($498,000.00); and
WHEREAS, the original contract term was 365 days from the effective date of the issuance of the Notice to Proceed, or May 11, 2023 through May 11, 2024; and
WHEREAS, Resolution 7R3-b, Adopted on March 20, 2024, authorized the Acting Director of the Department of Engineering to extend the term of the contract for an additional one (1) year, from May 11, 2024 to May 11, 2025, with such additional extension as required to complete the Concept Development study, as permitted by the Local Contracts Law, N. J. S.A. 40A:11-15(9); and
WHEREAS, the proposed schedule for the Newark Riverfront Pedestrian and Bicycle Access, Concept Development Study was proposed to be seventeen to eighteen (17-18) months; and
WHEREAS, the original contract project timeline was established in accordance with Local Public Contracts Law N.J.S.A. 40A:11-15; and
WHEREAS, Michael Baker International, Inc. has requested an extension of time as per the original project schedule, therefore additional time is required to complete the Concept Development Phase, Newark Riverfront Pedestrian and Bicycle Access; and
WHEREAS, Resolution 7R3-a, adopted on May 21, 2025, authorized the Acting Director of the Department of Engineering to extend the contract term for an additional six (6) month, from May 11, 2025 to November 11, 2025; and
WHEREAS, Michael Baker International, Inc. submitted on August 27, 2025 a Zero-Cost Modification (attached hereto) for the supplemental work performed; and
WHEREAS, the Acting Director of the Department of Engineering request an extension of the contract term for the additional six (6) month, from November 11, 2025 to May 11, 2026, with such additional extensions as required to complete the Concept Development study, as permitted by the Local Contracts Law, N.J.S.A. 40A:11-15(9).
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor, and/or his designee, the Acting Director of the Department of Engineering, is hereby authorized on behalf of the City of Newark to execute Change Order No. 3, a contract amendment to Contract No. 2021-02PS with Michael Baker International, Inc., One Gateway Center, Suite 2330, Newark, New Jersey 07102, for the Newark Riverfront Pedestrian and Bicycle Access, Concept Development Study Project. The amendment will extend the contract term an additional six (6) months, from November 11, 2025 to May 11, 2026, with no additional cost to the City of Newark.
2. The authorization to execute Change Order No. 3/Contract Amendment to Contract No. 2021-02PS is ratified back to November 11, 2025.
3. A fully executed copy of Change Order No. 3/Contract Amendment to Contract No. 2021-02PS, shall be filed in the Office of the City Clerk by the Acting Director of Engineering.
4. No other changes to this contract are allowed without prior Municipal Council approval.
5. Any further extensions, as may be permitted by N.J.S.A. 40A:11-15(9), are subject to Municipal Council approval.
6. Notice of this Change Order for a professional services contract, in accordance with N.J.S.A. 40A:11-5(1)(a)(i), shall be published in the official newspaper of the municipality, which notice shall be filed in the Office of the City Clerk for inspection by the public.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to execute Change Order #3/Contract Amendment to Contract #2021-02PS, with Michael Baker International, Inc., One Gateway Center, Suite 2330, Newark, New Jersey 07102, for the Newark Riverfront Pedestrian and Bicycle Access, Concept Development Study Project, for an additional six (6) month extension of the contract term, from November 11, 2025 through May 11, 2026, at no additional cost to the City of Newark.
