Additional Information:
This resolution will authorize a second extension of Emergency Contract #E2025-14, which was awarded to VDA, Inc., in an amount not to exceed $375,000.00.
The first extension was authorized by Resolution 7R1-b adopted on February 04, 2026. The extension was for the period from January 16 through April 16, 2026.
This current Resolution extends the contract for an additional (90) days through July 16, 2026.

WHEREAS, the Elevator Sub-Code Official retired as of October 1, 2025, leaving only one part-time elevator inspector, which poses a direct risk to the public safety and hampers the City’s ability to issue Certificates of Occupancy for new construction projects in need of proper inspection and approval of elevator systems; and
WHEREAS, on October 16, 2025, the Director of the Department of Engineering requested a declaration of emergency for elevator inspections, certifications, and plan reviews for approximately 3,000 vertical mobility devices in the City; and
WHEREAS, on October 16, 2025, pursuant to N.J.S.A. 40A:11-6 and N.J.A.C. 5:34-6.1(a), the Qualified Purchasing Agent, QPA, approved the aforementioned request, and the City entered into Emergency Contract # E2025-14 with VDA, Inc., 120 Eagle Rock Avenue, Suite 310 East Hanover, New Jersey 07936, for a not-to-exceed contract amount of Three Hundred Seventy-Five Thousand Dollars and Zero Cents ($375,000.00); and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contacts may be entered into when an emergency affecting public health, safety or welfare requires the immediate delivery of goods or the performance of service; and
WHEREAS, on February 04, 2026, the Municipal Council adopted Resolution 7R1- b extending Emergency Contract #E2025-14 ninety (90) days, from January 16, 2026 to April 16, 2026, with no changes in the total not-to-exceed contract amount of Three Hundred Seventy-Five Thousand Dollars and Zero Cents (375,000.00); and
WHEREAS, the Department desires to extend Emergency Contract #E2025-14 an additional ninety (90) days for the period commencing April 16, 2026, through July 16, 2026; and
WHEREAS, the absence of these critical services, if not addressed, poses a direct risk to the public safety and severely hampers the ability to issue Certification of Occupancy for new construction projects, which is a significant public safety hazard for City residents and others utilizing existing elevator systems and a major disruption to residential and commercial occupancy throughout the City; and
WHEREAS, repairs are needed to protect the safety and welfare of City residents and to enable the continued inspections and plan reviews of elevators throughout the City; and
WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011 limits the period of emergency contracts to ninety (90) days and permits extensions only with the authorization of the Municipal Council.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The extension of Emergency Contract #E2025-14 with VDA, Inc. 120 Eagle Rock Avenue, Suite 310 East Hanover, New Jersey 07936, for the provision of elevator inspections, certifications and plan reviews for approximately (3,000) vertical mobility devices is hereby authorized for the period from April 16, 2026 to July 16, 2026.
2. This emergency contract extension is ratified back to April 16, 2026 through the date of adoption of this authorizing resolution.
3. Funds are available under the Department of Engineering budget account code: NW026 026 0109 46260 B2025.
4. The Purchasing Agent shall file a copy of Emergency Contract #E2025-14 and any and all documents amending same in the Office of the City Clerk and shall post a copy of the emergency contract and extension on the City of Newark’s website within forty-eight (48) hours.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of the contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This resolution ratifies, and authorizes the extension of Emergency Contract #E2025-14 with VDA, Inc. 120 Eagle Rock Avenue, Suite 310 East Hanover, NJ 07936, for the continued provision of elevator inspections, certifications and plan reviews for approximately (3,000) vertical mobility devices throughout the City of Newark. The extension is from April 16, 2026 through July 16, 2026 for a total not-to-exceed amount of Three Hundred Seventy-Five Thousand Dollars and Zero Cents ($375,000.00).
