WHEREAS, pursuant to Resolution 7R3-F adopted on September 6, 2012, the Municipal Council authorized the Deputy Mayor/Director of the Department of Economic and Housing Development, on behalf of the Business Administrator and the City of Newark, to enter into and execute a Fair and Open Agreement with La Casa de Don Pedro, Inc., of 75 Park Avenue, Newark, New Jersey 07104, for the purpose of providing physical rehabilitation services to its facility located at 23 Broadway, Newark, New Jersey 07104, in an amount not to exceed $40,000.00; and
 
WHEREAS, the term of the Sub-Recipient Agreement has expired and the Deputy Mayor/Director of the Department of Economic & Housing Development seeks authorization to enter into and execute a First Amended Agreement to extend the term of the Sub-recipient Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013, to allow La Casa de Don Pedro, Inc., to complete the above referenced project.
 
      
 
 
 
NOW THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
  1. The Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development, are hereby authorized to enter into and execute a First Amended Sub-recipient Agreement with La Casa de Don Pedro, Inc., 75 Park Avenue, Newark, New Jersey 07104, to extend the term of the Sub-recipient Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013 to allow La Casa de Don Pedro, Inc., to complete the physical rehabilitation services to its facility, 23 Broadway, Newark, New Jersey 07104.  
  1. The First Amended Sub-recipient Agreement between the City of Newark and the La Casa de Don Pedro, Inc., is hereby ratified from January 1, 2013 to the date of adoption of this authorizing resolution.
  1. No additional City funds are required for the First Amended Sub-recipient Agreement.
  1. Except as amended herein, all other terms and conditions of Resolution 7R3-F 090612 and the Sub-recipient Agreement authorized therein shall remain in full force and effect.
  1. The First Amended Sub-recipient Agreement is in compliance with the Local Public Contracts Law including, but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Community Development Block Grant, 24 CFR 135 (Section #3 reporting requirements) and 24 CFR. 570.201(c).
  1. An executed copy of the First Amended Sub-recipient Agreement shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic & Housing Development on behalf of the Business Administrator.
 
STATEMENT
 
      This resolution ratifies and  authorizes the Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development, to enter into and execute a First Amended Sub-recipient Agreement with La Casa de Don Pedro, Inc., of 75 Park Avenue, Newark, New Jersey 07104 to extend the term of the Sub-recipient Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013 to allow La Casa de Don Pedro, Inc., to complete the physical rehabilitation services to its facility located at 23 Broadway, Newark, New Jersey 07104.
