Emergency Contract #E2025-07 for the period of March 31, 2025 through June 30, 2025 was awarded for an amount not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) for the Department of Public Safety Reconstruction of the Bay Floor-Fire Engine 5.
An extension was adopted on August 06, 2025 for the period from July 01, 2025 through September 30, 2025.
A further extension was adopted on November 06, 2025 for the period from October 01, 2025 through December 31, 2025.
This current Resolution of Emergency Contract #E2025-07 further extends the contract for an additional (90) days through March 31, 2026, or until the expected completion of the reconstruction project in February 2026.

WHEREAS, on March 31, 2025, the Department of Public Safety declared an emergency for immediate reconstruction of the floor bays that house fire apparatus Engine 5, located at 65 Congress Street, which among other issues, has been the subject of Public Employee Occupational Safety and Health (“PEOSH”) violations, due to signs of deteriorated concrete and holes, cracks on structural columns and beams supporting the bay floors in which the renovations will allow the Fire Division to enhance firefighting operational readiness; and
WHEREAS, on April 1, 2025, the Purchasing Agent accepted the declaration of emergency for reconstruction of the floor bays that house fire apparatus Engine 5, resulting in a contract in the amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) with Power Concrete Co., Inc. 497 Raymond Boulevard Newark, NJ 07105 (“contractor”); and
WHEREAS, on August 06, 2025, the Newark Municipal Council adopted Resolution 7R1-y extending Emergency Contract #E2025-07 an additional (90) days, from July 01, 2025 to September 30, 2025, with no changes to the total not-to-exceed contract amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) and
WHEREAS, on November 06, 2025, the Municipal Council adopted Resolution 7R1-e further extending Emergency Contract #E2025-07 an additional (90) days, from October 01, 2025 to December 31, 2025, with no changes in the total not-to-exceed contract amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) and
WHEREAS, the Department of Public Safety desires to ratify and authorize a further extension of Emergency Contract #E2025-07 for the period commencing from March 31, 2025 through June 30, 2025; and
WHEREAS, Emergency Contract #E2025-07 continues to address a matter of imminent harm to the health, safety and welfare of Newark residents; and
WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b) and (c) limits the period of emergency contracts to ninety (90) days and precludes extensions of emergency contracts without authorization by the Municipal Council; and
WHEREAS, the Department of Public Safety now seeks ratification and authorization by the Municipal Council of Emergency Contract #E2025-07 to prevent interruption of, and to continue the reconstruction of the floor bays that house fire apparatus Engine 5.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator, and/or the Purchasing Agent, QPA, are hereby authorized to execute an extension of Emergency Contract #E2025-07 for reconstruction of the floor bays that house fire apparatus Engine 5 with Power Concrete Co., Inc., 497 Raymond Boulevard Newark New Jersey, 07105, for the not-to-exceed contract amount of Five Hundred Twenty Five Thousand One Hundred Dollars and Zero Cents ($525,100.00).
2. Said extension of Emergency Contract #E2025-07 is ratified back from January 01, 2026 through the date of adoption of this authorizing Resolution.
5. Funds are available for Emergency Contract #E2025-07 in an amount not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) under line appropriation of the Official Budget, which shall be charged is:
(i) Fund: NW051-G25-F25D0-72090-B2025
6. The Purchasing Agent shall file copies of all documents related to Emergency Contract #E2025-07 with the Office of the City Clerk, and pursuant to ⸹2:5-13.2 of the City Code, the Purchasing Agent shall post the emergency contract on the City’s website within forty-eight (48) hours.
7. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
This Resolution ratifies and authorizes the Mayor, and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, to extend Emergency Contract #E2025-07 with Power Concrete Co., Inc. 497 Raymond Boulevard Newark NJ, 07105, from January 01, 2026 through March 31, 2026 or until the expected completion date of for the completion of the contract, which is February 2026. The original not-to-exceed contract amount of Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) remains unchanged.
