This Resolution amends Resolution 7R2-e(S) adopted on October 26, 2021, to adjust the grant amount, adjust total project cost, and remove the residential properties located at 519 So. 11th Street/Block 309.01/Lot 34/Central Ward and 521-523 So. 11th Street/Block 309.01/Lot 35/Central Ward, which are not eligible for Hazardous Discharge Site Remediation Fund funding as recommended by the NJEDA.

WHEREAS, a grant and loan fund was established, jointly administered by the New Jersey Department of Environmental Protection (NJDEP) and  the New Jersey Economic Development Authority (NJEDA), known as the Hazardous Discharge Site Remediation Fund (HDSRF) codified as N.J.S.A. 58:10B-1 et seq., dedicated for the provision of financial assistance to municipal governmental entities, individuals, corporations, partnerships and other private business entities for the purpose of financing remediation activities for sites, at which there is, or is suspected of being a discharge of hazardous substances or hazardous wastes; and

 

WHEREAS, the City of Newark (the “City”) has determined that there has been, or it suspects that there has been a discharge of hazardous substances or hazardous waste on the properties located at 192-198 16th Avenue, 184-190 16th Avenue, 519 So. 11th Street, and 521-523 So. 11th Street, Newark, New Jersey 07103 and commonly known as Block 309.01, Lots 24, 30, 34, and 35 on the Official Tax Map of the City of Newark, (the “Original Properties”); and

 

WHEREAS, on October 26, 2021, the Municipal Council adopted Resolution 7R2-e(S) (“Original Resolution”) authorizing the submission of an application to the New Jersey Economic Development Authority (“NJEDA”), through the New Jersey Department of Environmental Protection (“NJDEP”), requesting grant funding from the Hazardous Discharge Site Remediation Fund (“HDSRF”) Grant Program for preliminary assessment (PA), site investigation (SI), and remedial investigation (RI) work for the remediation of the Original Properties, with no matching funding required by the City (the “Application”); and

 

WHEREAS, the NJEDA conducted a preliminary review of the City’s Application and recommended that the Original Resolution and Application be amended to remove the properties located at 519 So. 11th Street (Block 309.01, Lot 34) and 521-523 So. 11th Street (Block 309.01, Lot 35) having a historic use of residential and not eligible for HDSRF funding,  correct the requested grant amount, and correct the total project cost; and

 

WHEREAS, the City wishes to continue the processing of the Application with the removal of the properties located at 519 South 11th Street (Block 309.01, Lot 34) and 521-523 South 11th Street (Block 309.01, Lot 35), reduction the requested grant amount from $228,574.50 to $213,999.50, and reduction of the total project cost from $228,574.50 to $213,999.50; and

 

WHEREAS, the Municipal Council is committed to the redevelopment for a non-profit Heritage Center and as such authorizes the continued processing of the Application submitted to the Hazardous Discharge Site Remediation Fund (HDSRF), pursuant to the Original Resolution, for funding for the assessment and investigation of the properties located at 192-198 16th Avenue and 184-190 16th Avenue and commonly known as Block 309.01, Lots 24 and 30 (collectively “Properties”) on the Official Tax Map of the City of Newark, in order to determine the extent or the existence of any hazardous substances or hazardous waste; and 

 

WHEREAS, the Department of Economic and Housing Development desires to amend the Original Resolution and Application, as necessary, in order to proceed with processing the grant for HDSRF funds for the remediation of the Properties, which shall require the City to execute a Grant Agreement with NJEDA in order to obtain the grant award and commence work.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to proceed with the Application that was submitted to the New Jersey Economic Development Authority (“NJEDA”), through the New Jersey Department of Environmental Protection (NJDEP), requesting grant funding from the Hazardous Discharge Site Remediation Fund (“HDSRF”) Grant Program, for Preliminary Assessment (PA), Site Investigation (SI), and Remedial Investigation (RI) work, pursuant to Resolution 7R2-e(S) adopted by the Municipal Council on October 26, 2021, in accordance with the revised Scope of Work prepared by the Licensed Site Remediation Professional dated September 14, 2022, with no City funds required aside from the Five Hundred Dollars and Zero Cents ($500.00) processing fee, required.

 

2.                     Resolution 7R2-e(S) adopted on October 26, 2021 (the “Original Resolution”), shall be amended as follows: 1) the grant amount shall be changed from “to be determined” to $213,999.50; 2) the total project cost shall be reduced from $228,574.50 to $213,999.50; and 3) removal of the properties having an historic use of residential located at 519 So. 11th Street (Block 309.01, Lot 34) and 521-523 So. 11th Street (Block 309.01, Lot 35), which are not eligible for HDSRF funding.

 

3.                     The Municipal Council hereby ratifies its authorization of the Application, with the within changes, from the date of Application submission to the date of adoption of this authorizing Resolution.

 

4.                     Grant is hereby accepted upon receipt of notification of the grant award in the amount of $213,999.50.

 

5.                     A Five Hundred Dollar and Zero Cents ($500.00) processing fee is required for receipt or acceptance of this grant award.

 

6.                     Attached hereto is a Certification of Funds from the Director of the Department of Finance, which states: (1) that there are sufficient funds in the amount of Five Hundred Dollars and Zero Cents ($500.00) for the purpose set forth herein above; and (2) that the line appropriation which shall be charged is as follows:

7.                     All other terms of the Original Resolution shall remain unchanged and in full force and effect.

This Resolution ratifies, amends and authorizes Resolution 7R2-e(S) adopted on October 26, 2021, to specify the grant amount,correct total project cost, and remove residential properties which are not eligible for HDSRF funding within the Original Resolution and grant application, as applicable for Preliminary Assessment (PA), Site Investigation (SI), and Remedial Investigation (RI) work, for the property located at 192-198 16th Avenue and 184-190 16th Avenue, the proposed Heritage Center, Newark, New Jersey  (Block 309.01, Lots 24 and 30).
