Additional Information:

Resolution 7R1-c (AS), adopted on April 20, 2022, authorized the City of Newark's membership in the Sourcewell Cooperative Purchasing System.

 

This Resolution authorizes the Department of Public Safety to utilize Sourcewell Cooperative Public Safety Solutions Contract #030425-SND awarded to SoundThinking, Inc. to utilize subscription service, ShotSpotter, to provide gunshot detection, location, and analysis services throughout the City of Newark.

WHEREAS, on April 20, 2022, the City Council adopted Resolution 7R1-c(as) authorizing the City of Newark’s (“City’s”) membership in the Sourcewell Cooperative, 202 12th Street Northeast, PO Box 219, Staples, Minnesota 56479 (“Sourcewell”), a nationally-recognized and accepted cooperative purchasing organization comprised of contracting units within the meaning of N.J.S.A. 52:34-6.2b(3); and

 

WHEREAS, N.J.S.A. 52:34-6.2b(3) and Local Finance Notice 2012-10 authorize New Jersey contracting units to purchase goods and services without public bidding under a nationally-recognized and accepted cooperative purchasing agreement where said agreement resulted from the utilization of a competitive bidding process by another contracting unit located either in New Jersey or in any other state; and 

 

WHEREAS, Sourcewell maintains local vendor-cooperative contracts which are competitively awarded and through which its members can make advantageous purchases; and

 WHEREAS, cooperative purchasing is an inclusive term used to describe all purchasing systems where two or more contracting units join together for the provision or performance of goods or services as provided by the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and

WHEREAS, the City's membership in Sourcewell Cooperative has been confirmed active; and

WHEREAS, the Department of Public Safety requires advanced gunshot detection, location, and analysis technology to enhance public safety operations, improve emergency response times, and support crime reduction initiatives throughout the City of Newark; and

WHEREAS, the Department of Public Safety has determined that ShotSpotter subscription services provided by SoundThinking, Inc. offer the necessary technology and operational capabilities to support these public safety initiatives; and

WHEREAS, the Department of Public Safety requests authorization to utilize Sourcewell Cooperative Public Safety Solutions Contract #030425-SND for ShotSpotter services from SoundThinking, Inc. (ShotSpotter), 39300 Civic Center Drive, Suite 300, Fremont, California 94538, at a cost not to exceed One Million Eight Hundred Sixty-Eight Thousand Eight Hundred Ninety-Three Dollars ($1,868,893.00) per year; and

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1.                     The Mayor and/or his designees, the Business Administrator, and/or the Purchasing Agent are hereby authorized to utilize Sourcewell Cooperative Public Safety Solutions Contract #030425-SND from awarded vendor SoundThinking, Inc. 39300 Civic Center Drive, Suite 300, Fremont, California 94538 for subscription service, ShotSpotter, to provide gunshot detection, location, and analysis services for the Department of Public Safety at a cost not to exceed One Million Eight Hundred Sixty-Eight Thousand Eight Hundred Ninety-Three Dollars ($1,868,893.00) per year with a not to exceed total contract amount of Five Million Six Hundred Six Thousand Six Hundred Seventy-Nine Dollars and Zero Cents ($5,606,679.00).

 

2.                     The contract term shall commence upon approval by the Municipal Council from June 30, 2026 through July 17, 2029, inclusive of any extensions available through Sourcewell.

 

3.                     All purchases, purchase orders, and related documentation shall be in accordance with the relevant Sourcewell Cooperative Contract, including Standard Terms and Conditions, Method of Operation, and Third-Party Agreement, if applicable, as contained in the New Jersey State-approved cooperative contract documentation and agreements.

 

4.                     Pursuant to N.J.A.C. 5:30-5.5(d)(2), this contract is subject to the availability and appropriation of sufficient funds. Certifications of Funds shall be issued prior to the incurrence of any contractual liability and charged against Budget/Department of Public Safety NW011-190-1902, various accounts and budget years, and all allowable and approved Public Safety Grants and Capital funding sources. Immediately after the 2026 Final Budget is adopted a Certification of Funds for the remaining balance shall be prepared and filed together with this Resolution and the executed contract in the Office of the City Clerk. Beyond the temporary budget period, the professional services agreement authorized herein shall be subject to the availability and appropriation of funds."

 

5.                     Sourcewell Cooperative Contract #030425-SND complies with the Local Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and constitutes a Fair and Open Procedure.

 

6.                     The Division of Central Purchasing shall file a duly executed copy of the contract in the Office of the City Clerk, if applicable.

 

7.                     If required by State law, the City Clerk shall provide the appropriate Notice of Award to the State Comptroller no later than twenty (20) business days following such award in accordance with N.J.S.A. 52:15C-10.

This Resolution authorizes the Mayor and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent to utilize Sourcewell Cooperative Public Safety Solutions Contract #030425-SND awarded to SoundThinking, Inc. 39300 Civic Center Drive, Suite 300, Fremont, California 94538 to utilize subscription service, ShotSpotter, to provide gunshot detection, location, and analysis services for the Department of Public Safety at a cost not to exceed $1,868,893.00 per year, with a not to exceed total contract amount of Five Million Six Hundred Six Thousand Six Hundred Seventy-Nine Dollars and Zero Cents ($5,606,679.00) from June 30, 2026 through July 17, 2029, inclusive of any extensions, inclusive of any Sourcewell-authorized extensions.
