WHEREAS, on July 2, 2025, the City of Newark (the “City”), pursuant to N.J.S.A. 40A:11-1, et seq., publicly advertised and solicited bids for the Harriet Tubman Square Improvement, Contract #2025-02R; and
WHEREAS, on July 31, 2025, in accordance with the public advertisement, two (2) bids were received, publicly opened, and read aloud for Contract #2025-02R for the Harriet Tubman Square Improvement Project (“Project”), located 501-551 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey; and
WHEREAS, the project specifications required that bidders construct the Project in accordance therewith and with the proposed Contract Documents; and
WHEREAS, Zenith Construction Services, Inc. (“Contractor”), the lowest bidder on the Project, submitted a bid in the total amount of Five Million Two Hundred Twenty-Five Thousand One Hundred Forty-Six Dollars and Zero Cents ($5,225,146.00), per the project specifications and N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, the Contractor possesses the required qualifications and/or identified all required subcontractors per the bid specifications such that there are no material defects in the Contractor’s bid and therefore, the Contractor is the lowest responsible and responsive bidder for the project; and
WHEREAS, the Acting Director of the Department of Engineering has determined that it is in the best interest of the City to accept the bid proposal and enter into Contract #2025-02R with the Contractor.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering (“Director”), are hereby authorized to award Contract #2025-02R to Zenith Construction Services, Inc., 365 Thomas Boulevard, Orange, New Jersey 07050 (“Contractor”) for a total contract amount not to exceed Five Million Two Hundred Twenty-Five Thousand One Hundred Forty-Six Dollars and Zero Cents ($5,225,146.00) for the Harriet Tubman Square Improvement Project, which is located at 501-551 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey. The contract term shall be for a period of three hundred sixty-five (365) consecutive calendar days from the date of the issuance of a written Notice to Proceed.
2. The Acting Director of Engineering has determined that the Contractor is the lowest responsible and responsive bidder and recommends award of the contract.
3. A Certification of Funds issued by the Chief Financial Officer of the City of Newark is attached hereto, certifying that sufficient legally appropriated funds are available for this contract in the following budget accounts:

4. No changes to this contract shall be allowed or authorized without prior Municipal Council approval.
5. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Acting Director of Engineering and/or her designee.
6. This contract is to be completed within 365 consecutive calendar days from the issuance of a formal Notice to Proceed.
7. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5 et seq.
8. No advance payments shall be made against this contract in accordance with N.J.S.A. 40A:5-16.
9. If required by State Law, the City Clerk shall provide the appropriate Notice of Award to the State Comptroller within twenty (20) business days of the award, in accordance with N.J.S.A. 52:15C-10.
STATEMENT
[This Resolution authorizes the Mayor and/or the Acting Director of the Department of Engineering to award Contract #2025-02R to Zenith Construction Services, Inc., for the Harriet Tubman Square Improvement Project, located at 501-551 Mayor Kenneth A. Gibson Boulevard, Newark, New Jersey in the amount not to exceed $5,225,146.00. The contract is to be completed within 365 consecutive calendar days from the issuance of a Notice to Proceed issued by the Acting Director of the Department of Engineering and/or her designee.
