WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") for the 2025 Safe Streets to Transit Program (SST Program) provides grant funding for infrastructure improvements for traditional and non-traditional transportation initiatives that enable and encourage walking and bicycling to transit; and

WHEREAS, the City of Newark (the "City") desires to obtain funding from the 2025 SST Program to improve Heller Parkway Safety Improvement in the designated Transit Village Area; and

WHEREAS, the Acting Director of the Department of Engineering will submit an electronic grant application on July 1, 2024 to NJDOT, on behalf of the City of Newark, requesting grant funding in the amount of One Million Three Hundred Seventy-Six Thousand Five Hundred Sixty-Nine Dollars and Fifty Cents ($1,376,569.50), from the New Jersey Department of Transportation's 2025 SST Program, to improve the Heller Parkway Safety Improvement in the designated Transit Village Area, with no City funds required; and

WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City is required to submit a resolution from the Municipal Council authorizing submission of the grant application; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and

WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering, shall submit a copy of the grant agreement to the Office of the City Clerk, the Corporation Counsel and the Business Administrator for review, approval, and signature.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to submit an electronic grant application to the New Jersey Department of Transportation on behalf of the City of Newark, requesting grant funding in the amount of One Million Three Hundred Seventy-Six Thousand Five Hundred Sixty-Nine Dollars and Fifty Cents ($1,376,569.50), from the New Jersey Department of Transportation's 2025 Safe Streets to Transit Program (SST Program), to improve Heller Parkway Safety Improvement in the designated Transit Village Area, with no City funds required (a copy of the application is attached hereto and made a part hereof).

2. The Municipal Council of the City of Newark recognizes and accepts that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from the New Jersey Department of Transportation, does further authorize the execution of any such grant agreement upon review, approval and signature by the City's Mayor and Corporation Counsel; and also, upon receipt of the fully executed agreement from the Department, does further authorize the acceptance of the grant funds and the expenditure of the funds pursuant to the terms of the agreement between the City of Newark and the New Jersey Department of Transportation.

3. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award from the SST Program to improve Heller Parkway Safety Improvement in the designated Transit Village Area.

4. Upon notification of the receipt of a grant award in connection with this application, the Acting Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to the Office of the City Clerk, the Corporation Counsel and the Business Administrator for review, approval, and signature.

5. No municipal funds are required for receipt or acceptance of this grant award.

6. The Acting Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and grant agreement in the Office of the City Clerk.


STATEMENT

This Resolution authorizes the Mayor and/or his designee, the Acting Director of the Department of Engineering, to submit an electronic grant application, to accept and enter into an agreement for grant funding from the New Jersey Department of Transportation's 2025 Safe Streets to Transit Program in the amount of One Million Three Hundred Seventy-Six Thousand Five Hundred Sixty-Nine Dollars and Fifty Cents ($1,376,569.50), to improve Heller Parkway Safety Improvement in the designated Transit Village Area. No municipal funds are required for receipt or acceptance of this grant award.
